Hi David,
I'm so sorry for this I've been a mess. I found my last esa form copy and it was 10/12/18 when it was submitted with added GP letters etc but now I don't know if I did have a WCA. I lost all my backup data on my phone and don't know if I had one. I found a job centre letter from April of 2019 saying we have looked at your claim again following a recent change from 27 February 2019 you will receive £127.15 because a decision on your capability for work you have been placed in the support group and from 10.aprilnyour money will be £128.45 because of a change in money coming in you meet the eligibility criteria for the support group. I know that we started getting help to put in a couples claim around the end of March/beginning of April 2019 and I don't know if while it was happening our payments were stopped
I don't know if this was after we first started trying to join our claim
When we first tried they denied us a couples claim and said my partner was on contributions based when he wasn't and then said we needed to go on UC because I was moving from a different area but I wasn't becoming a tennant or claiming HB or CT and thanks to advice from here we eventually stayed on esa. Does this mean the messages in my journal are correct and I will have to provide fit notes?
Someone also said I should quote regulation 19 of the transitional regulations about the fit notes. Is that something that relates to me.

The messages in your Journal are incorrect and you don't have to provide Fit Notes. I would take photos of the letters from 2019 confirming that you are in the Support Group.
You need to send a Journal message choosing the option A Payment. In the Journal message I would write -
I was given ESA Support Group status following a WCA in 2019. I was a single claimant then and received National Insurance Credits. Subsequently when I became a partner in a couple ESA claim, I continued to receive National Insurance Credits. As there was no gap in my eligibility to receive National Insurance Credits due to an ESA claim my Support Group status is protected. The relevant legislation is the The Social Security ( Credits ) Regulations .
Let me know how you get on.

Hi David, does it matter that I don't know if I had a work capability assessment? I don't recall having to do one face to face. It might have been a decision made on evidence I provided. I think my last face to face WCA might have been Dec 2016 or Jan 2017 and then I didn't get another ESA form in until end of 2018.

I'm just realising as well, and I apologise because I have bad brain fog. I have been diagnosed with new things since our claims were joined and I wasn't getting assessed and so I didn't inform the DWP because I didn't know/realise if I had to and with the UC migration Input the new conditions down. Could it be related to this? And will I then need a WCA? I am so sorry. I just realised I'd forgotten to update them. I thought because my partner was the lead claimant it was more about his conditions which I know sounds stupid. I started getting new diagnosis around 2023.

No it doesn't matter if you can't remember about the WCA. The important thing is that you have kept the letter stating you are in the Support Group. So that means you won't have to complete form UC50 and have a WCA. The Jobcentre Work Coaches are notorious for making mistakes on this subject. If they continue to request Fit Notes then I can point you in the direction of a manager to make a complaint.

No you are not obliged to inform the DWP of additional health conditions. You were placed in the ESA Support Group and you should retain that status until your next WCA medical.
