Please be aware: this article deals with the DWP seeking new powers which some claimants may find distressing to contemplate. 

As the DWP steers a bill to give it access to 9 million claimants’ bank accounts through parliament, it is already pushing for additional powers of arrest, search and seizure.  In effect, the DWP is aiming to have its own anti-fraud police force and to be able to impose huge fines without going to court.  But should such plans go ahead?

Lessons from recent history
The current Post Office scandal is clear evidence of what happens when such powers are misused and there are some worrying parallels between the behaviour of the Post Office and the DWP, as we noted earlier this month in Post Office Horizon software originally aimed at claimants

And there is no doubt that the DWP are serious about getting these powers. 

In a May 2022 report entitled ‘Fighting Fraud in the Welfare System’ the DWP said that “we plan to create new powers so our officers will be able to undertake arrests and apply to search and seize evidence in criminal investigations, when parliamentary time allows. This will enable them to act in a timely fashion, without always having to rely on police resources.”

And last year we reported on a survey which the DWP claimed proved that the majority of the public want them to have such powers.

The DWP say that these powers will be used against “serious and organised fraud”, but how long would it take them to decide that allegedly fraudulent PIP, ESA or UC claims by individuals constitute “serious” fraud?

It is important to note that in the same May 2022 report the DWP used exactly the same phrase “when parliamentary time allows” in relation to creating legislation that would force third parties, including banks, to hand over data to them. 

The following year those provisions were slipped into a bill going through parliament and they are now at committee stage in the House of Lords. There appears to be no serious attempt to prevent them going through.

 So a DWP police force is a genuine possibility and the same technique of adding the provisions to an existing bill in order to allow it may be used again.

Huge fines
The same document also explains that the DWP want powers that allow them to introduce a new type of “civil penalty”, whereby they can impose very large fines on claimants they suspect of fraud, without needing to meet the burden of proof required in criminal courts or even to actually take the claimant to court. 

The fine will be based on a percentage of the amount the DWP believe, but cannot necessarily prove beyond reasonable doubt, the claimant has been overpaid.  It will be in addition to the claimant having to repay all of the alleged overpayment.

Your experiences
When concrete plans to introduce such powers are produced, it’s vital that claimants and the bodies that represent them are not caught unprepared and without evidence about what the results might be.

Crucially, we need to know whether the DWP is open, transparent, subject to effective scrutiny and has an ethos of abiding by the rules and regulations that govern its conduct

So, we’d like to know if you have always been treated fairly by the DWP or if you have you been left feeling helpless in the face of an organisation that makes rules, but doesn’t necessarily follow them itself?

For example:

  • Have you tried to report a change of circumstances by phone and been unable to get through?
  • Have you reported a change of circumstances in writing and received no acknowledgement?
  • Have you sent the DWP documents by recorded delivery, but they have denied receiving them?
  • Have you been threatened with legal action if you didn’t repay money without it ever being proved that you owed it?
  • Have you been told you must withdraw a claim for a benefit immediately or face prosecution for fraud, even though you know you have done nothing wrong?
  • Have you been interviewed under caution without being able to have anyone with you?
  • Have you been offered a deal by the DWP whereby you have to agree immediately to accept an award of a disability benefit that is lower than you think you should get or have the offer withdrawn and have to go to appeal instead?
  • Have you been treated in any other way that suggests the DWP cannot be counted on to follow rules and regulations and treat claimants fairly?

    Usual DWP using a sledgehammer to crack a nut approach, its not the benefit claimants that need looking into, but the DWP, and its staff, who already appear to be a law unto themselves? Lost documentation, that takes some people ages to compile, sent by Post Office Special Delivery, and still they lose them?  We get 28 days to respond to a form, they get as long as they like? Staff not all trained to the same standard, so information is different, depending on who you speak to. THE Government needs to get the DWP to get its own house in order first, before it considers harassing benefit claimants, and stop putting millions into the hands of contractors, by taking out of the pockets of genuine benefit claimants.....

      @Navigator So agree - systems need to be urgently reviewed. All the money spent on tech and they can’t communicate in a timely and provable manner.  No awareness or accommodation for external factors (such as postal delays or covid etc).

    Gone are the years when customer service of any kind was a genuine person on the end of the phone in this country. In the rush to reduce costs companies and government departments have increasingly focused on IT programmes and systems taking the place of human decision making. These systems and programmes are only as good as the people who designed them and run them
    . A future with AI replacing all human contact is terrifying if you look at the current Post Office scandal. Gone are the friendly bank managers who knew you and whom you could have a conversation with.  Capitalism in all its forms and the use of AI do not bode well for the vulnerable in our society. If the DWP want to look at my bank account then they are very welcome to do so, I have nothing to hide from them but what worries me is that if they see something they don't like that their processes will be heavy handed and very quick rather than begin a line of communication to clarify the matter. The Inland Revenue and the DWP have never been known for their sensitivity and caring nature.

    This is a deplorable idea.A total invasion of someones privacy.I am utterly disgusted with thr DWP and the police even considering the idea.I would take you to the court of human wrights on this ,and many more people would think the-same.Shame on you DWP

    I get PIP disability payment and after reading many newspaper articles about various medical conditions that you can claim for I phoned them, I was told I would have to undergo a reassessment which would look at everything including my current award and that in the worst case I could be refused and also lose what I am getting ? this information meant I declined the reassessment, I feel these tactics are meant to frighten people like me who know nothing about the benefits system ? and guess what ? it worked !

    This is blatantly power and hate hungry Tories , trying to control and take over each aspect of people's lives . 
    This isn't happening in any other country in EU  and I don't get how people and disabled representing organisations allow it and agree to it ? 
    1. It is illegal- simple as that .
    2. It goes against human rights and it should be strongly objected to by the opposition.

    Just awful. Bad enough having to deal with current DWP and PIP assessment staff. Now they want a "police force". I had to deal with PIP and I currently fear for the health of my daughter, who has mental health issues and has anxiety attacks when DWP contact her.
    I'm fine with the concept of reasonable and fair assessment for benefits. We don't have that now but these new targets go far beyond.
    To those who say it's OK to look at their accounts as they've nothing to hide, I say careful what you accept for it's a very slippery slope

    Like wading through treacle to get any response...
    Pip claim 2.5 years old and still waiting for a date for tribunal...
    Obvious mistakes made in phone interview, but no correction offered, or explanation given!
    Third party involvement (C.A.B.) absolutely necessary!
    Gained basic pip, but no mobility, even though I can't
    Get about enough under their rules for distance, or because of frequency of use with appliances for meds...
    Nor are they taking my partner's attendance with a standby appliance into account...
    I don't think "Fair" is a word in the DWP training manual!
    Their role seems to be just to give the minimum possible benefits to all, and to make the disabled, aged, and infirm fight for every penny...

    I definitely wouldn’t feel safe with the DWP being able to have that level of power in its hands. Considering the UN is expecting the government to attend a meeting in March (having refused to attend 1 in Aug 2023) over its treatment of disabled people. The government is expected to show evidence to prove that treatment has improved since 2016 when it was first told by the UN the treatment was unacceptable, (my words as I can’t think of their exact wording). So knowing the government is in ‘trouble’ with the UN and doesn’t give a damn, do any of us really believe it will stop its own DWP dept to do the right thing. For those interested, go to the Disability Rights Uk article dated 28th August, UK government refuses to attend UN meeting scrutinising its rights violations. Another interesting article by Byline Times dated 25th Aug, Sunaks government accused of hiding from damning UN Inquiry. I have to wonder what the UN can do to actually force the government/DWP to back off with its aggressive stance towards all of us.

    I  would be more than happy with a police team being involved as it would hopefully out a shop to fraudsters and people claiming what they aren't entitled to, I had to go thru some very stringent things to get the pip I now get plus am now awaiting a medical to get my limited capability for work money, I am sure if universal credit got intouch with pip I wouldn't have to go through the stress of the medical but according to universal credit staff they don't interact with staff at pip

    Judging by the DWPs own appalling record on underpaid pensions to war widows, divorcees etc and them even giving me a 50% reduction in my own  State pension - which I challenged and had corrected via help if Sir Steve Webb.  Add the fact the DWP does NOT want State Pensions on any Pension Dashboard....why?.....I think the public has an absolute right for a Police force to MONITOR DWP ACTIVITIES. NOT vice versa. 

    Contrast 5000 staff employed to check benefit fraud Vs 500 staff in the High Earners Special kid-gloved staffed office.....I'm sure mistakes by claimants on the latter group would Afar, far outweigh those value of the former group.  DWP is an abusive, corrosive office helped by cretinous companies such as ATOS, Crapitaetc etc etc....who like PI 'auditors'  undoubtedly work on bonus for proving fraud against another vulnerable group eg disabled. 

    It's getting more like a police state in the UK daily.

    What we need at the moment is a script writer and a production company to produce a TV about the DWP.
    I have just had an hour-and-a-half phone call with my claim. They were working on a claim form I sent in about two years ago!
    I had experiences with a previous claim, and paperwork going astray, I have given updates about my illness and when it came to the interview. was it in the report?
    I suffer from COPD. I got to one interview and I was out of breath. I told the interview this and did it come up on my report, nope but I did mention it at my appeal

    The number of people intentionally defrauding the DWP is assuredly minuscule. Unfortunately, it is incredibly easy for politicians and bureaucrats to punch down and aggrandize themselves by being 'hard on crime' without a moments care or attention for the vulnerable people they destroy in their malicious disregard for facts or logic.

    I have tried to claim pip twice now and twice they have scored me all zeros on all questions I completed this is totally unfair as I do have a disability which affects me all the time due to a motorbike accident in April 2023 can I complain to the ombudsman about this as pip assessors seem not to have even looked properly at my claim the same person has scored me zero both times this has happened to other people also please reply as soon as possible thanks

    Do not think it is reliable for any company to police its self. There are too many conflicts as we have seen with the Post Office scandal.   We have very if any trust in these companies or government offices anymore.  I was denied PIP for a year and then had it reinstated the following year at the time of the appeal I was in shock as the person who had been helping me I had just found out that day had died.  I felt intimidated at the court and  they seemed totally hostile I left in tears and then had to struggle for 12 months.  My mental health suffered and my health in general. There was no redress and I was so mentally ill I could not cope.   It seems the people who need the help are the ones put through hell to get it even with all the proof and doctors letters and support.   Having worked and paid into the system only to be pushed from pillar to post in trying to get the help you need, which you have paid into and then made to feel you are nothing.

    The only power the DWP should have is suspecting the claimant permanently lives outside of the U.K, and would need to provide evidence in a court of law.. individual claimants have differing needs and their expenditure will always vary. Yet another attempt by a government department branding claimants asmalingerers in order to gain popularist backing from the political masters

     DWP to a tribunal to stop them from attempting to claim back monies they said paid to me wrongly. They based the evidence on a letter apparently sent to me disqualifying from disabilities.

    Our dealings with the DWP have proven to be extremely fraught and with them being able to believe the untruthful assessment reports, far too long-winded. One would hope that the Gov't would learn from its experience with the Post Office, but is that too much to ask?

    I once had them ring me up unexpectedly and tell me my ESA was being discontinued as they felt I could work one or two hours a week! I had to take them to appeal to get it reinstated.
    I feel that DWP staff are operating well above their "paygrade", with many making decisions that they do not have the knowledge to make.
    They often disregard evidence completely, I took some evidence with me to an assessment for PIP once, the assessor ignored it completely, I had to remind her several times that she should photocopy it and include it in the evidence file, she never did so.
    They assess claimants on completely non-medical terms; I was told that I couldn't be as disabled as I suggested because I was well dressed, that I obviously could walk as I had walked down the corridor (disregarding the pain it cost).
    I have been claiming DLA/PIP for over 20 years, EVERY time they awarded me nothing and I had to take it to appeal who then awarded me the DLA/PIP, the last couple of times I was awarded the enhanced rate of both Care and Mobility by the Tribunal despite the DWP giving me no points. My final claim was again given no points, so I wrote a stinging letter suggesting that they look at their records and that I would take them to appeal and given past evidence I would win, so why not check it now before I took them to appeal. They awarded me enhanced Care and Mobility indefinitely within a couple of weeks.
    I am strong enough to fight them, with your help, but many are not and do not take it to appeal, I think this a callous method of denying benefits.
    I do not trust them one iota.
