The DWP is to begin continuous surveillance of the bank accounts of all pension credit, universal credit and employment and support allowance claimants using powers under a bill currently going through Parliament.  The department have said that they intend to use their new power to force any third party to pass on data to them more widely in the future.

The power to compel third parties into providing any data that the DWP wants in order to search for fraud and error is being conferred in last minute amendments slipped into the Data Protection and Digital Information Bill, which has now passed its third reading in the Commons and moved to the Lords.

Initially the DWP say that they will use their powers to oblige the UK’s top 15 banks to monitor the accounts of all means-tested benefits claimants and report every time an account goes over the  capital limit or is used abroad for more than four weeks.

Because every DWP payment into a bank account has an identifying code attached to it, all banks know exactly which of their customers is on benefits and which benefits they receive.

Setting up software to automatically send details to the DWP of every claimant account that goes over the capital limit or is used abroad for more than four weeks will be very straightforward for banks.

The DWP say that each identified claim will be investigated in the normal way and that penalties will not be automatically imposed.

At the moment, almost 9 million claimants would be caught in the surveillance net, including:

  • 5.8 million universal credit claimants
  • 1.6 million employment and support allowance claimants
  • 1.4 million pension credit claimants

Any bank failing to collect and pass on data to the DWP will be subject to heavy fines.

 The new system will begin to be rolled out in 2025, though all banks may not be fully involved before 2030.

The DWP estimates that it will cost around £30 million a year for them to investigate potential fraud identified by the new system, but that they will save £500 million a year through reduced fraud and error.  

They also estimate that over the first ten years, the new powers will result in 74,000 prosecution cases and 2,500 custodial sentences.  

There is no doubt that the DWP intend to use these new powers much more widely.  The impact assessment for the new powers says that:

“The power is not limited to a specific type of data or type of institution/Third-Party to allow us to fight new fraud and error issues as they emerge and engage with new institutions as efficient opportunities become available to us.”

Later, the same document says: 

“This measure is drafted broadly . . .  to enable DWP to apply this measure to non-financial organisations in future if it is deemed appropriate and proportionate”

The new surveillance powers for the DWP appear to enjoy cross party support. Only 51 MPs voted against the amendment, with 30 of those being SNP and just 7 each from Labour and the Lib Dems.

Anyone who imagines that the DWP will use such sweeping powers reasonably and proportionately probably hasn’t ever claimed benefits.

And they probably also don’t remember the Regulation of Investigatory Powers Act, which was brought in to combat terrorism and organised crime and ended up being used to spy on dog walkers, pigeon feeders and people putting out their wheelie bins too early.

Capital and abroad fraud account for less than 15% of benefits fraud and error. The DWP will want to delve into many other aspects of claimants lives in order to identify the other 85%.  This is, beyond doubt, the thin end of a very thick wedge.

    Big Brother Watch are writing about this subject and how the benefit system is becoming a panopticon for the disabled.  They have sent me an e book about the state of surveillance but I cant copy the link.  It was part written by a manchester representative for the disabled.  Big brother watch is well worth supporting as they oppose all this stuff.  CBDCs, spy cameras covering the uk etc.

    Thank you to all those people who have signed the petition. I am attaching the link again for those people who haven’t yet seen it.  It would appear that the politicians have forgotten that we, the public, employ them, we are not under contract with them, they are under contract to us. They have no right to infringe our Rights, discriminate against us or assume that we are all of dubious character and employed in fraudulent activities.

    Thus has been going on for years. I know a man who trains the dwp to access banks of claimants thus is over 14 years. Disgusting. Finances and health should be PRIVATE .
    I keep my money in a safe and avoid the banks like the plague.

    The house of lords are pretty decent people compared to the commons.

    There's no way this is getting through, although they can't completely stop a bill they can make life hard for the commons to the point it's watered right down to basically ve worthless anyway.

    A group called Organise are running a petition about this and asking for people to write to their mps.  Thousands have already written to them but dont rely on other people get active and push back on them.  This is an outrageous over reach by govt. with very little consultation to justify it.  They are trying to sneak this through on the QT.  As Stephen Timms said in parliament why do they also need the details of thousands of pensioners?  Remind people that this wont stop at the disabled govt want to snoop on all of us and for what purpose?   Sign the petition and write to your MP.  They hope to get this through without much fuss.  Dont let them get away with it!

      @MrFibro Of course you can thousands pushed back on digital ids and marched and they weren’t brought in during covid.  They will keep trying but they just want to see how much push back they get.  We are the many they are the few remember.  Every little act is huge when added together.

    This is an obvious breach of human rights that is my and all others to privacy if this goes ahead I want the right to have checked every mp and Lord in this country for their interests when being lobbied so we can weed out the fraudsters in government also their interests in all  deals at home and abroad

    So what about all the tax fraud committed by the richest 10% which accounts for a lot more money and fraud than any benefits fraud, but this is acceptable by the government as most of them use loop holes created by them to help them avoid taxes. But as always its the hardest hit that pay the price, I am not saying that every claim is legal or correct but the tax dodgers far outweigh them, but nothing is or ever will be done.

      @K And for those on benefits who are protected by the Equality Act 2010 on the grounds of a protected characteristic such as disability then I imagine there will be quite a few successful discrimination claims. And rightly so because this really does amount to discrimination.

    My PIP and today’s payment of winter fuel allowance will have pushed my savings account above the limit for pension credit. I do not leave excess in my current account as every tiny amant of interest is valuable. Someone looking at my account today would say I was above the limit next week I have nearly £1000 in bills to pay out of this money which will take me below the limit again. I suspect a lot of individual save over the month and pay their bills at the end   Most of us will use a savings account to do this. The DWP monitoring this would be taking money and then giving it back. The amount of  pointlessly wasted time and paperwork wouldn’t justify the amounts paid into the treasury. I hope there is going to be some sanity guidelines when this comes into force.

    I get pension credit. I do not have a problem with DWP confirming my savings. I have 2 concerns I am a nominated Administrator for a dead persons estate. I am required by law to keep safe the sums that have refused by first line recipients. I have to do this for 7 years until I can distribute to the next level of beneficiaries. These monies have to be kept in a bank account, preferably attracting some interest otherwise I would be considered negligent. I can supply documents providing the current status of my accounts and of my position as an Administrator. There would be no need for DWP to deal with the bank directly as the information I can supply would be a complete picture. My second concern is regarding DWP making a decision on information gathered direct from my bank and assuming that all the monies held in the account was mine to spend.
    If recipients of benefits refuse to provide proof of savings then there is justification for a direct approach to their bank. As always my concern is the level of skill of the individuals reviewing these accounts and the context that cause people to declare savings that are different to the amounts held in accounts.

      @DragonWolf I would get a couple of opinions on your situation and not declare anything yet.  Try the Citizens advice or similar.   If the bank account is in the deceased person's name and not your own I don't think it should be a problem.

    Does this include PIP, tax credits, Housing Benefits? I can see Tax Credits mentioned but it references 121DA, which isn't in the document. Can we get some clarity on this?

      @Wiggles It includes any income based benefits administered by DWP so does not include PIP or Housing Benefit (Local Authority). However all claims for tax credits and Housing Benefit will end and you will have to make a claim for Universal credit which is administered by DWP and is income based.

    Surprised, I'm not.

    Did you know that all financial trading organisations, and banks, like Ebay and Paypal, are / have now been obliged to report your trading and balance exceeding £1000 a year to be shared by government department's inc DWP & HMRC and Local Authorities. Using AI to filter the results will mean not only will DWP be on your back if you exceed their thresholds, so will HMRC and Local Authorities where HB or council tax allowances are given. You may also find yourself liable for capital gains tax.
    Should you trade with your hobby on say Ebay, or any platform, and "turnover" more than £1000 a year, your liable, they are obliged to provide the information on you, un-prompted. Whats more, move, spend, attempt to hide or dispose of assets, including money, even from under your mattress, makes you liable for Money Laundering, and subsequent incarceration in prison. Did you also know, your liable for Capital Gains Tax if you sell your possessions worth over £1000, or any of the above collectively.
    The Tories, not having raised allowance thresholds, will have been largely ignored by many, but this brings millions more people into liability. Tied up to this is the little acknowledged digitisation of Health Records, that are being administered by Donal Trumps empire for the UK, which will be covertly available, again to all government departments, who will know more about you than you yourself.

    Happily, there are exceptions, being Off Shore Accounts, Race Horses, and vehicles, funny that.

    So while the snoop law is not yet in force until passed by the Lords and ratified, enough powers are in place and coming together to penalise just about all citizens. Local authorities have jumped the gun, asking for bank statements showing both income AND expenditure. If you get such a demand, refuse until these powers are law. Now why do you think that expenditure might be of interest, yes you guessed it. By the way, postings on this, and any other website will come under the same legislation.

    Several years ago, I had an investigation officer on my doorstep after the DWP found money I had in a savings account. It was extremely distressing, with threats of stopping my benefit, seizure of assets etc. This was money that I did not need to declare because I was not above the capital limit according to the rules - but that didn't stop the DWP reducing my benefit for years and I lost probably around £6000 in total. If the DWP won't follow the rules, they shouldn't expect claimants to. Good luck to anyone genuinely struggling with health issues and not getting enough money to live on - do whatever you need to do to survive - you are not being dishonest.
    I guess that if a kind person gives a donation to charity while in receipt of means-tested benefits, the DWP will deduct the amount from your benefit!

      @Moss I believe that they have always been able to find out how much you have in savings by the amount of tax you pay each year on your account. Once more than a certain amount is paid hmrc will inform them. So you have to ask what this is going to be for ?? I imagine it will be used mostly for pip to track individuals who say they are unable to do certain things. The payments will show what they are doing day to day for example going to concerts football matchs etc etc

      @Akire24 So the fraud thing is people saving way above the capital limit etc. whelp I hardly have any savings in any of my bank accounts, whenever I get paid from DWP I spend it on essentials and bills/food more than anything. 

      I think they will find out that a low amount of people actually commit these crimes (or the ones that do it 24/7 are swerving DWP fraud officers). 


      Anyway good luck to all, luckily my bank providers are not in the top UK banks.

      @Jaf Excatly if you are fiddling the system then you will work around it. Get wages paid into other peoples accounts. Cash cash cash. Those who accidentally Go over because they are in hospital for months and are not spending anything will be getting harassing fraud letters for
      Owing £50 in back pay.

    This is the reason banks are closing, pushing for you to use the App. (Which if you read terms & conditions, they have access to EVERYTHING on your phone)All the surveillance will be done by AI and algorithms. There will be no privacy, don’t have a smart meter either, because they will be able to immediately cut you off, not able to do this yet, but that’s on the cards too.

    Dwp have just requested my bank statements. They give me the money, they know better than me what I've got in the bank
    And has anyone noticed that when you receive your bank statements it says private and confidential on the envelope?
    I haven't got more than 6k in the bank, they're fully aware of this.
    I'd much sooner have my health back and not have to relay on the benefits system

      @siobhan You can have up to £6,000.00 max at any one time.  If you have between £6000.01 to £15,999.99 the excess amount will result in deductions to your benefits.
