I first decided to claim ESA and then DLA after. That means I couldn't tell ESA about DLA until after I decided to claim DLA. :lol:

If I have already sent a copy of my fit for work form, my GP's phone number a copy of 3 of my consultant orthopaedic foot surgeons reports, 1 independant consultant orthopaedic surgeons report am waiting to see an independant othopaedic professor and will send DLA a copy of his report. :woohoo:

Also another copy of my consultant othopadeic foot surgeons report when I have seen him on 27th April. Then put on a waiting list for a subtalar joint fusion which should be about 8 - 10 weeks. Then in plaster for at least another 12 weeks. With my mum doing even more for me. :kiss:

What do you think the chance of getting both HRC and HRM. Without having a medical or EMP coming to my house? Because if they want proof knowing my luck they will want to send one to my mums house where I live on the day of my operation. So they will have to go to the hospital instead. Then they will have to beleive I need the help I said I do on the form. Especially for my right ankle even if they don't about my slipped disc, which is true about the help I need.

My pain management consultant said next time I he hime if none of the other drugs he has prescribed for me haven't worked. He will prescribe me morphine patches instead :woohoo: :cheer: they will make me feel very :X I'm sure but if they work who cares, I don't. I am fed up of taking tablets that don't do nothing for the chronic/severe pain in my back and right ankle.

I have had problems with my right ankle for 4 years this May and my slipped disc in my back since 19/09/99. Have been in plaster or an Aircast boot all this time and nor been able to move about or do anything for myself becuase of the slipped disc in my back and the right ankle problems.
Need help all day and in the night at least 1 - 1 and a half hours when I need to change position, get comfy, pick my quilt up off the floor and to go to the toilet with me because either my right ankle gives way or my left leg because of my slipped disc in my back. I can't stand up again myself so my mum gets me up off the floor everytime.

Also can my mum get carers allowance even though she gets her own state pension and my late dad's works pension. Or does my mum have to wait until I hear from DLA even though she has cared for me since 1999? I don't think it fair if my mum don't get anything because she has been my rock :cheer: and so have the people in this forum.

There is no technical reason why your mother cannot claim CA for you, although I would advise seeking face to face advice before doing so to ensure there is no impact to her as a result of her doing so.

You need to be in receipt of DLA HRC or MRC for her to be able to claim CA, should you be awarded one of these levels of Care, she can then backdate her CA claim by 3 months or to the start date of your DLA, whichever is later.

Thanks Gordon for replying to my query. From the information I have given do you think there is any chance of me getting HRC and HRM?

Or can't you say? :unsure: Also from the information provided do you think I would have to appeal or go to a tribunal?

What are my chances if you know of having an EMP come to my mums house to see me? Or me having to go to somewhere else for me and my mum to see someone? Or can't you say?

One last thing, it's not fair why can;t I get CA for my mum she has done all my cqring for me and can't get anything until I hopefully get MRC/HRC? :angry: It just isn;t fair. My mum deserves a medal yet can't get ant money unless I do, it just isn't fair. I feel like crying for her. :(

Everybodies case is unique, so no one can really say whether you will be eligible, or if you are, what rates you will be awarded. The best thing I can suggest is for you to read the guides, and look at how you can map your disabilities onto the tests.

I do know that for HRC you will need to show that you have care needs both day and night, so you will need evidence to support this.

If your claim is rejected or awarded at a lower level than you believe it should have been, then you have an automatic right to appeal the decision, but hopefully you won't need to do this.

My impression is that EMPs regularly hold medicals for DLA at claimants homes, unlike ESA, where it is nearly impossible.

I am afraid CA is not a seperate benefit, it can only be claimed as the result of someone getting HRC or MRC, there is just no way around this.

Korky, sorry to hear of your problems, and to be the bearer of bad news.
But as someone who has middle rate care allowance, my husband has his state pension (he is 10 yrs older than me!)
But State pension and Carers allowance are known as overlapping benefits you are only able to have one or the other.
Perhaps you or your mum could get some benefits advice from Cab.

Suzy, I also have an older husband (11 year gap) on State Pension but he gets a smaller amunt of Carers Allowance for me under the 'Underlying Entitlment Rules' of which we were unaware until told about by Welfare Rights, it may be worthwhile looking into for yourselves :)
