Your question is quite difficult to answer as we do not have all the facts.

When you receive your benefits they are not classed as capital for the period over which they are paid, some examples of this are Carers Allowance which is paid weekly, ESA is fortnightly and PIP is four weekly.

Once this period has elapsed, any benefit that has not been spent becomes capital and counts against your total.

If you have more than £6k in savings and you are below SP age then you will be affected by tariff income, some claimants use some of their savings to pay for their funeral plan.

Last December whilst under a 4 month review of my bank accounts I won my PIP case in court. I was awarded Higher Rate of PIP. More importantly I was given my backdated money of 14 months. Circa £10000. Therefore by default I was over the £6K threshold and I didnt report the amount to the DWP as they were the ones who gave me back my backdated payment..Funny enough they called off the 4 month investigation 2 days after I received my backdated pay.My question is that surely I should have 14 months leeway whilst I have that money in my account. I did put some money into a personal pension. Am I to be penalised by the DWP for having more than £6k in my account because of monies they owed me?

I understand your argument - but I don't think the DWP will give you a 14-month leeway. It's normally 12. However, it doesn't matter what we think - it's a fight that you will have to have with them.
