The DWP under Labour are fighting in the High Court to defend a Tory consultation con about proposed changes to the work capability assessment (WCA). Their vigorous support for misleading Tory tactics raises question marks about what deceptions Labour have planned for their benefits Green Paper, due to be published in the Spring.

In September 2023, the Conservative government launched a short, eight week consultation on a variety of possible changes to the WCA.  The proposals were presented as a way to help more disabled claimants into work.

In November 2023, the government published its response to the consultation and set out changes to the activities and descriptors in the WCA which would make it harder for new claimants to be found to have limited capability for work-related activity.

The Office for Budget Responsibility then revealed that whilst 450,000 new claimants would be over ÂŁ400 a month worse off as a result of the changes, just 15,400 would find jobs by 2029.  In other words almost 97% of those affected would be worse off.

Disability campaigner Ellen Clifford launched a judicial review of the consultation last year, on the grounds that people talking part in the consultation were not given enough information to give an informed response, but were instead misled into believing that the changes were about helping people into work.

In particular, the failure by the DWP to carry out any employment or disability impact assessment before consulting made the process unfair.  The DWP, however, did look at 300 WCAs that had already been carried out to get some idea of how much money they would save, but did not make this information public.

When Labour came to power they could have simply conceded the case, accepting that the consultation was unfair and that its results could not be relied upon.

As Labour say they are going to devise their own changes to the WCA and publish a Green Paper in the Spring for consultation, that would have been the end of the matter.  There would have been no need to rerun the unfair Tory consultation.

Instead, the DWP under Labour have fought the case tooth and nail.  When a High Court judge ordered the DWP to disclose documents to Clifford’s team at the Public Law Project, the DWP refused and tried to get the order overturned.

That attempt failed and the DWP had to hand over the documents, but even then the judge said they were worried that the DWP was interpreting the grounds of the judicial review very narrowly so as to avoid disclosing other relevant documents.

The case was finally heard on 10 and 11 December 2024 and the decision will be announced in the New Year.

But, whatever the result, the vigour with which the DWP under Labour fought to defend dodgy Tory tactics is a cause for real concern.

It may be, as some have suggested that Labour plan to make very similar cuts to the WCA, and that is why they tried to uphold the consultation.

But there is another, perhaps more likely explanation.

What Labour are seeking to uphold is the idea that the DWP should be free to carry out consultations about changes to benefits without the need to be open or honest about what the real purpose or effects of those changes are.

They want the High Court to agree with the DWP that it is fine to work out how many people will be plunged into poverty only after a consultation has been completed and the decisions made.

If the High Court finds in favour of Clifford, however, the DWP may have to do some urgent rewriting of their Green Paper on changes to the health and disability benefits.  Given that Labour have said they will match the ÂŁ3bn in benefits cuts the Tories had planned, they may even have to tell the truth about how many people will lose out under their proposals.

    Hello all, whilst this is not strictly the correct thread, I thought the following would be of interest as it will highlight the dilemma Governments (both here and in Europe face) with a rapidly ageing population:

    According to the Office for National Statistics, 52.8% of people receive more in benefits than they pay in tax. Remove those on the state pension, it is still the case that about four in ten working age people receive more in benefits than pay in tax (I've just checked my payslip - I am one of them).

    Unless the Labour Government is going to substantially raise the state pension age (rapidly) to over 70 years (the political fallout of that, considering they are not going to compensate Waspi women) would be enormous - and the old tend to vote! Therefore, it is going to be those of working age who are feel the brunt of welfare reform.  Benefits are for subsistence living only (but many on the right loathe even that).  I know for some disabled people work is impossible, for many like myself who have sensory impairments, you really need to try and find some form of employment as the welfare system is going to become more punitive.

    My MP recently informed that Labour had to take action against the '10 billion in welfare fraud'. When I challenged him to explain where he got this figure from he refused to reply. This government is continuing Tory austerity by using the old divide and rule trick. 
    I recently spoke to a senior decision maker in our regional ICB and he told me that they had been ordered by NHS England to continue operating in 'austerity mode'.  He said that due to the national insurance raise in the recent budget, funding for staff pay rises and capital expenditures on hospitals that there would be nothing left to hire more staff.
    This Labour government will be directly responsible for more avoidable deaths of vulnerable claimants and sadly they will get away with it. 
    It is time to join the fightback against the attacks which are coming.

    Absolutely Nobody can survive adequately  on 311.68 or 393.45 respectively. Even after housing, council tax and warm house discount are taken into account. Particularly if they are alone, unwell or disabled. It's not acceptable in a so called civilised society in 2024. The under 25 divide is ludicrous.

    I have come to the conclusion that politicians of all parties left,centre or right care nothing for people with chronic disabilities. We are seemingly just numbers to be attacked when they can't sort out anything else out. Or keep their pledges. 
    Over the last 15 years they have promised to do so much and achieved absolutely nothing. They have failed at everything except directing the nations veiw on people on benefits. There they are the frauds,cheats,lazy work dodgers they are living off your backs. Your taxes. They are laughing at you. Do you want us to get tough with them ok we will.
    These politicians have been in charge of everything,every policy but it's us that are to blame. 
    They will not accept responsibility for anything.

    It is yet again the case of the current labour government actually just continuing the desires of Ian Duncan smith of running disabled people and oap,s in to the ground -not even having to bother any inspection in to the consequences of such actions. This current government are an absolute disgrace!

    What really are the differences between Labour, the Tories and even Farage's Reform in regards of physically and or mentally disabled/incapacitated people on out of work benefits? Nothing is the answer. They detest them because of the money that's why. 

    I will keep banging this drum, severely mentally incapacitated people cannot work because not only they could be a danger to themselves but to us, the public at large. Politicians are putting our safety in danger in more ways than we can think of.

    You cannot trust a liar , in no way , shape or form , keir starmer is not Labour and never was , his God awful lieutenants, kendall, reeves , keir starmer was only interested in one thing , the priministerial wage EVERY year for life ( nothing more ) an autocratic, dictator ( don't do as I do , do as I say ).       The big issue have an article that I found today from newsnow, going into more detail about Ellen Clifford’s dwp action. A worthwhile read. Sorry I’ve not attached it here, but my technical nous is limited.
      I can’t help but cringe whenever I see Starmer in the media. When he’s not trading insults with badenoch about what they have for lunch, he can be found rubbing up the wrong way as many groups of people that he can. So that includes, but is in no way limited to, the disabled, waspi women, pensioners and charities affected by the budget. Makes you proud to be British.

      @S I couldn’t agree more. Very well put. If the judges rule in Ellen’s favour, it really will be time to celebrate, all of us. God forbid if the dwp win, it really means the green light to them to continue with their policies and procedures designed to cause maximum, deliberate harm. That really is sobering.
