Over 15,000 claimants could be entitled to an average of £5,000 compensation following a victory by solicitors Leigh Day on behalf of 275 people who lost their severe disability premium (SDP) on being transferred to universal credit (UC).

Leigh Day had earlier won in the High Court on behalf of claimants TP and AR, arguing that the loss of SDP and in some cases enhanced disability premium (EDP) on transfer from legacy benefits to UC was unlawful.

This led to the DWP setting up the SDP Gateway in January 2019, to ensure claimants did not immediately lose out by up to £180 a month on transferring to UC.

However, an estimated 15,000 claimants who transferred before this date have lost money. 

Solicitor Ryan Bradshaw of Leigh Day brought a case for compensation on behalf of 275 of these claimants and the DWP have now settled.  Each claimant will receive an estimated £5,000.

However, there are many more claimants who have had nothing.  Ryan Bradshaw said:

“I am glad to have settled this claim on behalf of my clients. However, there are thousands of others who have been similarly affected who have not been in a position to bring a claim like this.

They too will have experienced the loss of £180 a month after they were moved from legacy benefits on to universal credit in the years before January 2019. They too will have suffered unnecessary stress.

A suitable scheme, compensating all the people who have endured discrimination at the hands of the DWP, ought to be urgently put in place. The mistakes made here should never be repeated.”

    We had to go on UC in March 2021, and we also lost a lot of money coming off of ESA on to UC because we are a mixed age couple and my husband started to get his pension so then I myself  had to claim UC, but I didn't get any payment because of mine and my husbands pips
      so it looks like we will not be receiving anything back for this  order being made.
    i sincerly hope everyone who lost out gets payback form UC

    Hi I was in email support group in 2017 and in late 2018 I was moved to UC lcwra will I qualify for this compensation ?Many thanks

    I imagine people like myself who are in the not fit for work IR ESA group won’t be so lucky though. I’m now £960 a year worse off since transitioning to UC. Makes me laugh how they’re on about offering claimants a loan to help them out when they’re going to have no means of being able to pay it back. Then to top it off this government want to spy on our bank accounts making us feel criminals. It’s such blatant discrimination and this government think that they can pick on the most vulnerable people in our society because we won’t fight back. They’re actually creating a mental health crisis by acting like this, but they don’t care.

    And don't forget they are forcing the most vulnerable into "Compulsory Debt" when migrating from ESA to UC.
    Run on for ESA, HB, etc, is only 2 wks, but 1st payment from UC takes 1 mth +7 days. We have to find min 3-4wks income and rent or get #DWP loan.

    Makes it easier to control people.

    Benefits have been cut to the bone and provide the barest minimum to just about survive ... but then they expect us to be able to repay a loan each month?

    With WHAT!? If we're repaying a loan to @DWPgovuk then we won't have enough to actually live on and will need another loan! Disgusting and crazy.

      @Ross I'm just what has the for example, housing associations etc to say about the tenant in debt for outstanding rents, because of the DWP's run on HB fault ?

      Which in turn will cause the claimants / tenants huge amount's of stress as a result of all of this.  Subsequently worsening the claimant/ tenants health through no fault of their own.

    I remember speaking with Leigh Day at this time, but as I was receiving some housing benefit paid by the local council and not within UC, was not protected under the transition rules / process.

    I wonder if someone could help me im so confused I've been on uc since 2017 I get contribution based esa enhanced pip. I get limited capability for work and work related activity.. should I have also got SDP on top ? Would be grateful if someone could help

    I have just been migrated to UC from ESA & although I found the forms etc ok, it’s the decision that has flummoxed me! 
    I am now part UC, part ESA & cannot make heads nor tails of it! The workings of payments are different so I am unable to work out if I am still on the same rate or if it even works out to the same amount for 28 days.
    See, I bet I’ve confused you too now! 🤦‍♀️😂☺️

      @Shona Same here. Turned out IR ESA was moved to Cont ESA. So still receiving ESA separately from UC which we did not understand. Had to ring ESA twice to get to the bottom of what was happening as we expected ESA to just stop and everything be on UC.

    I sent my renewal forms in to pip on the 29th of August 2024. I received a text back saying they have received my renewal i rand in December to see if they had looked at it yet they said no but they will extend my payment for 53 weeks then I received a letter from them last week saying they still haven’t looked at my renewal in the letter it has been extended until March 2026. I can’t understand why it is taking so long I have only ever waited minimum of 8 to 10 weeks.

    It should be noted that although the SDP Transitional Payment will be paid alongside any other Transitional Payments when forced to migrate to UC, they will be reduced each year when there is a cost of living increase in benefits, so in effect you will get less money over time ie you will eventually lose SDP and other Transitional Payments. (A crafty way of Government reducing your benefits).

    I changed over in 2024 and immediately lost my SDP. I queried it lots in the journal thing online and it was never answered just that my husband now earned too much so I was due nothing it coincided with our eldest turning 18 so we lost our because our entitlement went from three children to two so then we earned too much so I lost my SDP and UC all at once. It's crippling us. I don't have the funds to take anything up legally though.

      @MrsB I think you should query this. SDP should not effect your child turning 18 as the payment is for you. Plus if your child is still in full time education you can receive CTC and CB until they reach 19. Also if you were previously getting SDP and your husbands earnings are the same now as then it shouldn't of been taken away from you. Contact your local council and ask for a welfare officer they will be able to help look into this for you and if needs be query it on your behalf. Keep logging everything on your journal and ask them to explain in detail. This will be your proof incase you need to appeal there decision. I had to write in my journal that I was going to get legal advice, within 4 hours I got a response back from them. JC was forcing me to attend face to face even though I told them and provided evidence that I'm bed bound and need medical transport to attend hospital appointments.

    hi i changed over back 2019 2020 i use to recieve full esa and full housing benifit but when changed to esa i lost most of this and due to this was forced to go into work as such as couldnt afford to live which affected me severerly as didnt work for long and was hard on mental health caused me distress and not able to find property to rent

    The Dwp scandal started before the Post office Horizon scandal ... now my disabled family use these words .. might I suggest your feelings of shame .. oh I know only too well vulnerable disabled people what politicians and so called Lords have verbally us all to be liars , workshy , disgusting .. * use these words to shame and waken up career Local Labour mp's .. turn the tables children .. turn the veracity of truth to bad choices .. evil choices against the most vulnerable in society .     We should all be compensated, firstly for the stress they've put us through, and secondly for the money we lose by being forced onto UC. 

    I won't get any inflationary increases now, and also have to pay council tax!

      @Bert Mine isn’t, I’m £80 a month worse off which is £960 a year. I barely have enough to live on despite being in the not fit for work group on IR ESA. Heads in bits and I’m sure this government would rather I’d be dead. They’re making life miserable for us folk who are either elderly, sick or disabled.
