In the last month, Benefits and Work has heard from four members who have received a backdated payment of PIP because of errors relating to the “Engaging with other people face to face” activity.  Payments have ranged from £5,000 to £12,000.

The DWP say they are looking at 326,000 cases where they may have got the law wrong.  However, they are moving extremely slowly and there may be many more cases which they have failed to identify.

But some of our members have had their awards looked at and found to be eligible for a lump sum payment:

“Had a call on Tuesday this week (5th) from a decision maker, she ran through a few questions with me, like how I prepared if I am going to go out and who I use as my support when I do that etc. She told me there and then that she was going to back date my claim to 2016 and increase it from standard to enhanced. I have just had just under £5K paid into my account today.”

“Got a phone call I’ve been awarded almost 10,000. This is from 2017 to 2023. I was moved over to ADP last year. My payment has gone up to enhanced also from standard.”

“My partner received a missed call Tuesday, text received stating they will call back Wednesday morning. It sent him in a whirlwind thinking they were going to stop his entitlement. The lady called as previously stated, spoke about the situation in hand and advised he would be receiving a payment in the coming days for almost £12,000. It has definitely come as a shock to say the least. I can confirm we hadn't made any contact with PIP (Dwp) in regards of this, they just contacted us.”

“i sent of a letter a month ago signed for heard nothing so i phoned them and they agreed they had it but no one had looked at it ? so i asked what now and he said someone will look at it and i said when he said i dont know??”

However, we do know that Midnight above, originally contacted the DWP in October last year asking for them to look at his case and finally had a text from the DWP in December saying they would deal with it by 11 February 2024.

In fact, it wasn’t until 5 March that Midnight got a call from a decision maker who asked a few questions and then made an immediate decision over the phone about back pay and an increase in their current award.

So, awards are being given to some people who contact the DWP, as well as those who just wait and are contacted out of the blue.

According to the DWP more than one five claimants who have been reviewed have received an award. 

We suspect that the rules are being applied as restrictively as the DWP can possibly manage. Nonetheless, if you think you are entitled to back pay then the situation is far from hopeless, whether you choose to contact the DWP or wait and hope that you will hear from them.

    I was awarded 3 different  awards with different amounts of points signed by the same person all with the same explanation on each 1 for high rate 2 for middle rate my claim got cancelled but my partner does everything as I can't socialise and have severe breakdowns . How do I check a claim that's been closed ?

    AA Hi I’ve put mr in as got letter saying not effected did they ring you with desicion or just put backdated payment in your account before or after you received letter

    I had to have my assessment in August 20019 I was part time until covid started I was classed as vulnerable so was not at work the whole time. Of covid dwp finally  assessed in August 2013 I recied.a text saying they was dealing with my claim finally  the dessition 2024 after sending more information I am so much worse can't work the enhanced my claim for daily living due to my c o p d anxiety also arthritis in my spine I can't go out on my own also hearing problems and they scored me 10 never inhansed I do online shopping unless my daughter takes me and I'm lucky if I can get around the shop due to pain .

    How does this work as my husband was on high rate dla  as he was vetran lost it because of my investagaiton  done 
    By dwp and pip kept on saying they couldent find his orignal claim form but dwp fraud investagion so.hes not getting right money  wat a way to treat vetran

    Iwas given a lower care 2019 or before year later i was put back upto higher care that i always had before from the start of DLA higher rates for both mobility and carer so i missed alot of benifit my carers my mobility was always kept higher rate but carer was lowered after asking for a review took over a year now i have pip and ESA higher rate never had much refund a month only so am i one of the ones owed back payment

      @Miss Romayne Singleton i am the same i used to be on dla and esa, then got put to a lower amount so when i went to pip i got the higher rates going to ask about it

    Is this uk 
    As I went from high rate of dla on both for life 
    To enhanced rate mobility 
    And standard rate of care for 2 years ,after a long wait on an internal appeal I got a call telling me I will get enhanced rate of both indefinitely, the face to face assessment was terrible, I went from a he to a she in two sentences

      @Richard Tell you better than that.. on one of my hospital reports I went from female to 'This gentleman '. Go figure. Also on one of my pip reports I was 32,I wish. I was 50 at the time.

    i was on low rate from 2012 and i was disabled with athrytus and bowel disease wich ended in coloscapy back 3 massive hops but was only granted low rate

    I am on stranded n I suffer with HS absess under my arms n it's really bad n hurts alot it stops me doin allsorts, sometimes I can't get our ov bed 😪

    Looking for advice,  I was awarded ADP last year but this was after my PIP application was refused. Nothing changed in my diagnosis, am I able to claim the PIP I didn't get?

      @Carol my assessment was the same even though my partner was with me i could not have sat there alone and bouts of crying she said she could stop the assessment but that i would have to have another one or my money why stop so my partner persuaded me to carry on i was phsically sick after ..when i my assessment came back o scored 0 she said i had engaged eye contact and was calm throughout !!

      @Jlee, Bath , UK I have contacted them to ask if I'm eligible for any underpayments for my wrongly being assessed on my ability to interact and socialise with other people outside of my home and if I am capable of doing that without the help and prompting of others. I am retired from work due to severe osteoarthritis anxiety depression hypertension and other health issues. I was also diagnosed with Post Traumatic Stress Disorder which resulted from a terrible ordeal threatened and held captive in my car by a  looked after youth I was transporting from police custody in the west Midlands to be placed in a care home in Manchester. I was threatened with my eye being gauged out with the keys he was holding against the socket of my eye and increased the pressure on my eye to get me to drive where he wants to. I was terrified and I was certain he would have injured me and I was going to lose my eye. He was determined I would do what he said to take him to his heroine addicted mothers address as his mates were sitting off at his mums house. The ordeal continued from 3am until 7.30am and I was on the motorway from 11pm at the start of my night shift  I was not going to his old address as I was scared of what I was going to be facing when I reached the address I was told he wanted me to drive to. But the point is that I was assessed by an ATOS employee who said she was previously a paramedics but she was looking for something different and she ended up with the face to face assessment stage for the DWP and PIP to complete the assessment of the applicant and their ability to do carry out the tasks in each component. I have lost all my confidence and I have become isolated from my friends and former colleagues, I have declined and made excuses for my not going to attend the event but the reality is the thought of having to be in a group of people in a restaurant  pub or anywhere else outside of my home is a terrifying thought I actually felt physically sick and I have never been able to get through the door without any support and encouragement from the family members or friends. My friend who has been a good support for me since I have been retired was with me and the assessor for about half an hour and so I was comfortable with her and she could leave me alone with the assessment. She was aware of the diagnosis of PTSD and the depression and anxiety I am having medication to help me to cope,  but seemingly she has recorded that I can interact with her and therefore I have no problem with socialising and mixing with others. So I scored 0 
      How would I know if I am included in the review of pip assessment

    Looking for a bit of advice I’m not sure if this applies to me I was on dla In 2016 I got the normal care rate but when I was put on pip in 2018 I got put on the higher rate will I get money back dated as I should have been on the higher rate when I was on dla I also never got the mobility which I should have been on when I claimed pip but got it when I went over to the Scottish payment

    I  my sons appointee. He has been placed in higher rate for UC as his Autism and Anxiety affect his ability to work. They realised and admitted they had made an error before the Appral hearing. Now we are going through an appeal for higher rate PIP due to his inability to mix and have conversations with people he doesn’t know and also his ability to follow conversations and also read and deal with letters ( hence me being his appointee) assessed at home by DWP as needing appointee!) however enclosing the new decision from UC and also sending that to PIP they have still stuck by him not needing help and support in these domains. I have sent a massive amount of information, it took three requests to have a copy of the medical assessment, and that really was farcical in its content.( I am a specialist nurse and hope I would never glide over such important needs such as these). 
    We are now waiting for the video tribunal hearing . This is where we were with UC when they backtracked and put him in the support group for work. I don’t know whether we will be as lucky as this again. I doubt it.
    He is a lovely 23 yr old lad who finally got diagnosed with Autism a year ago after many years of difficult situations, anxiety and depression. When will they stop putting individuals into such awful situations and cause more anxiety?? 😥

    I contacted the DWP nurmous times about this issue, they have never got back to me, and I had sent it recorded delivery. This was signed for, so they have received my letters.

    Hi all fellow B&W members. Hope all is well. I’m still unsure whether or not I’d be due any backdated payments. Hoping someone can steer me in the right direction. I was awarded 11 points for my PIP daily living in 2018 and given standard rate ( being 1 point short of an ‘enhanced’ award). I was attending a mental health facility at the time, although voluntarily. Prior to this I had CBT. Is it worth me contacting DWP regarding this? I am reluctant to do so for fear of ‘rocking the boat’ with them. I’ve always had a rule never to contact them unless I absolutely need to-but I can’t help thinking they owe me!! Can anyone proffer any advice? Thank you in advance

      @David I was in he same position they always gave me 10 points even though I was treated under the mental health act. I moved over to Social security ADP in July and I received a call from Pip to say that they had not been paying mme the right amount and that they would be paying £7654 into my bank, I received it 3 days later. I was also moved to the enhanced group so I had to contact ADP to inform them as they were still reviewing my new claim. This week I received £3.000 into my account and I have now been placed in the enhanced group on both components for 10 years I have went from 10 points and 11 points and now I'm on 26points for daily living and 16 for mobility. So yes you should be entitled to backdated payment, good luck.

      @Diane but what if you went to a tribunal and they denied you ? surely if it is the law then the tribunal got it wrong ? im not clear so if it went to tribunal and you won they will not look at the award ibut what if you lost at tribunal ?/

      @David Sounds like u could be due if Ur found to need support for face to face appointments given that Ur not already on the enhanced rate of daily living I would give them a call. Got this online if it's any use to u.

      The DWP is not reviewing claims if:

      The enhanced rate of the daily living part of PIP has been awarded continuously since April 6, 2016
      A Tribunal made a decision on a claim since April 6, 2016
      A decision not to award PIP was made before April 6, 2016
