Hi I do not know if anyone can help. I have MS and have been unable to work since November last year. I am still employed and my employer is in the process of making a claim under the firms PHI policy as I have been off for over six months and will not be able to return to my profession. If accepted the policy will pay me 75% of my salary until I retire. The payment is made by the insurers inclusive of tax and NI to my employer and they pay me as normal. It is a condion of my employers policy that I remain an employee. The question is am I able to claim ESA, my view has always been that as I will remain employed I would not be able to do so. Am I correct?

Hi Andrew, I too have MS, and my employer had an insurance policy. I am paid 75% of my salary minus the cost of Incapacity Benefit. If you are awarded ESA then you must inform the Tax office so that you can be taxed via your company on any monies you receive (as IB is not taxed at source). I am now in the process of filling out the dreaded questionnaire for ESA so that is an ongoing saga. Best wishes
