confusing letter from DWP was created by lochlisa
hello all,
received a very confusing old letter from DWP this morning regarding my latest ESA claim :-
it states:- The Claimant has provided evidence from her doctor which confirms a worsening of her condition and a statement from her carer.
'having considered all the evidence, I therefore revise the decision as follows: The Claimant is treated as having limited capability for work from and including xx.xx.xxxx pending assessment and is accordingly entitled to ESA from and including that date'.
Now, this is a 6 month old letter. As you may know when I had my home medical I scored 0 points and am now going to appeal.
Does this letter mean that the DM accepted my doctors and carers evidence and decided that I could have ESA but only on assessment rate until my latest medical or does it mean they accepted I had limited capability but did not place me in any group?

I'm not sure what you mean by "this is a six month old" letter?
Is the date on the DWP letter recent or is it a date from six months ago? If it is the latter, I don't understand why the DWP have sent a letter which is six months old? If it is the former, I can only surmise that because your condition has worsened which has been determined from supporting evidence, from what you have said, you have been placed in the work-related activity group?
I am led to believe however that following a reclaim for ESA in the circumstances you have described, you would have been assigned to the assessment rate pending the new medical assessment? Is there not a page attached to the letter which gives a breakdown of the ESA payments to which you are entitled?

Nope, that is all there is quoting decision dates from October last year. Nothing else at all.
I do know that after being refused last year the decision was overturned on evidence being supplied but then I was scheduled for a medical within my 13 weeks (which took 25 weeks in the end).
I think I may have to call them and ask for an explanation?
