I have just received a letter from ATOS informing me that I'm going to have a medical (I sent a DLA80 in before Christmas after having a letter saying that they had rec'd info that my continuing entitlement to DLA may be in doubt. I have been on DLA since 2003 and was awarded it indefinitely in 2008)
I've had a look at info on this site, inc the form the EMP will be completing.
One question I would like to ask, can I record the medical on a dictaphone?
I've heard so many horror stories of medical forms being completed and they don't seem to bear any resemblance to how the patient's health and problems really are.
Any advice would be very gratefully received.

If you overtly record the medical, the HCP is entitled to refuse permission, and they will.
It is legal to covertly record the medical, however, if you subsequently require to use the tape as evidence, it wil be liable to challenge and may not even be admitted as evidence. There are also limitations on your distributing the content to a third party.

Thanks for that, I am already planning my appeal and haven't had the medical yet!
I thought if I recorded it I could then go through it and pick out points from it.
