Hi Zelda, for what it's worth, if you think your medical records would reflect what you have told them, then I would go for it.

The money thing is a bummer, I paid for mine. It didn't cost me that much though.

Hi Zelda

Do you really have to pay?

I had an appeal hearing adjourned (at my request) and the judge decided to use the adjournment to obtain GP notes for the last five years. However I only had to sign to give the tribunal permission to obtain them, rather than obtain them myself.

If you do have to pay it may be possible to claim the money back. Unless another mod knows the rules I'll come back to this thread later.

@Rachel - thanks so much for that advice, when hubby read it he said 'see, i told you!'. What surprises me is the appeal evidence already housed some GP notes and they outlined how bad i was. Oh well, at least now, i've had time to digest it all, and i've come this far, one more tribunal won't hurt (much) :laugh:

@Derek - I think i may take your advice and find out if there isn't another route i can go down. It's an awful lot of money for us and if it doesn't help, it's quite something to stump out. However, hubby thinks that it can only help.

One general question, out of interest, if I mail all the evidence to them, could the panel in theory just write the decision to me, or would i have to go for another oral hearing?

I was in a similar situation to you. The tribunal panel requested my medical records direct from my GP at their expense.

It seems strange they're asking you to obtain them and foot the bill ?

In my case I had all my medical evidence in the tribunal papers, but the tribunal thought the evidence was too good and therefore fake ( hence why they requested full medical notes ).During my nth appeal they were finally satisfied the evidence was genuine, but still decided to award nowt.

But I've since found out that getting my MP involved was not a good idea.

I feel gutted for you havign your appeal adjourned....Unfortunately I was int he same position as you last friday, sleepless night all reayd for the debate after 16 months wait and mine was adjourned before I wnet by phone call.

Last friday I was absolutely gutted, thought that it was going to be over. This week, today how do I feel?....I feel like fighting to the last breath for what I thoroughly deserve. I am not going to give up, they say they want an independent medical for which they will pay, I expect it will be atos....I am sure that if they asked for the evidence they would take any costs on themselves, call them and check. I had a lette rwednesday explaing the reasons for the adjournment and the medicla etc and confirming they pick up the cost of it.

Fingers crossed for you, listen to your hubby and everyone else here and fight on....we will all be with you.

Hi Zelda

I've just looked at the Tribunals Service appeal leaflet. Unfortunately it states that they don't reimburse appellants for obtaining medical evidence unless they themselves commission it. I think it is outrageous that they have asked you to obtain it (and pay) for their benefit.

If you didn't want to attend the second hearing you would have to write to the tribunal and ask to switch to a paper hearing, but of course, it would be in your best interest to attend in case they have any more questions to ask.
