DLA refused - it's like reading about someone else was created by dianeb
Hi
I carefully took my time and filled in the DLA application following the guides given and sent it off on 26th October.
On 8th November my GP was contacted and he sent his report off on 9th November. On 10th November I was sent a letter refusing mobility or care and the reasons were like reading about someone else. I was convinced I'd been sent the wrong letter.
For example, it says I don't have anxiety or panic attacks....umm I've been on medication for this for over 20 years. I also take Diazepam when I know I'm having to go into a stressful situation. It says I need comfort and reassurance but not help for panic attacks or anxiety
It says I can go to unfamiliar places and social events...news to me
It says I don't need help getting dressed - tell that to my husband who has to help me get my lower garments on due to arthritis in my hip.
I am told I am able to cook a meal from scratch and am not at risk of neglecting myself, despite having severe depression and having to be forced to do things.
Today I went to see my GP and he is furious as he backed up my claim and put unknown on the areas he didn't know about.
It seems that the DM didn't actually read any of what was put as they can't possibly have reached these conclusions if they had.
So what now?
Please help me sort this. I have never claimed despite being 'eligible' for many years.

Time to get an appeal in. You use a form GL24 and you've got a month to get it in.
Appealing against a benefit decision (Form GL24).
Meanwhile, there's a guide to DLA appeals in the help for claimants area.

Hi Diane
If i was in your position i would immediately appeal but please remember you only have 1 month in which to do it. I applied several times for DLA and they kept refusing, so i appealed and went to tribunal, i won my case MRC unanimous decision. So please dont give in to it you have nothing to lose ad a lot to gain. It would be well worth reading the info on this site for appealing and going to tribunal.

hi dianeb
my medical report from my last medical is the same. it says very little about my conditions and does not say anything about most of them. yet, in the recording of it, the doctor talks about all my medical problems and what can be done with some of them

Hi Diane
I was writing the exact post you were 5 months ago when they turned me down flat with no medical.
I put on the form I could walk 8-10 meters tops with my crutches - without seeing me they decided I could walk over 50 with no support.
I told them my boyfriend and daughter have to wash and dress me and cook for me - without seeing me they decided I could do all of this with no help.
It's just completely and utterly illogical and a farce but unfortunately all too common.
Please, PLEASE do follow Survivor's advice and get your GL24 sent back (My boyfriend got the form from the local job centre) so you can appeal.
This is what I did and my tribunal is on Wednesday.

Thank you everyone, I'll get the form sorted tomorrow and off to them.
I think what upset me most is someone who has never met me, nor even spoken to me trying to imply that the past 20 odd years are all a lie. I've fought and struggled and have never in my life taken benefits, I've always worked and paid my own way. Every day is a fight for me and I have my processes in place to keep me balanced and safe.
How dare some faceless person tell me I don't have panic attacks and I don't need help.
Rant over and let the fight begin.
