Hi All,
are A.T.O.S professionals accountable for their actions in a similar fashion to ones G.P ( who follow the rules and regs. laid down by the G.M.C).
It would be interesting to know if one of their clients should fall resulting in serious injury while undertaking their Medical Assessment, or if a person is passed fit for work ( and subsequently does so) resulting in further medical complications or worse, if the Medical Professional involved, A.T.O.S or indeed the Government are responsible and thus subsequently accountable.

Hi,

All Health Care Professionals practising are accountable to the relevant professional body and in certain cases for serious breaches can be 'struck off'. It is however in practice quite difficult to substantiate complaints and professional assistance should be sought if going along that route.

As to 'corporate liability' again that is without the scope of this website and professional advice should be obtained.

Thanks for the reply Pete,
just considered it's relevance considering the current A.T.O.S / Government definition of illness/disability.
Personally I believe it's only a matter of time before someone will have to prove who is responsible thus accountable for an incorrect decision made by an A.T.O.S healthcare professional it's a shame they would have to walk into a legal minefield in order to do so.
