Hi
A little history about me first. I was awarded HRC in December 2005 for 4 years and last year when I sent my renewal form in they dropped me to LRC but after having a reconsideration they put me on MRC; I didnt appeal at the time as my welfare advisor said it wont be a good idea to try to get my HRC back. I have been award MRC & HRM for indepantly.

My night time needs havent been taken in to consideration as I doubly incontinant and still do have accidets during the night which means that i have to change my bedding which means that i will be in pain for the rest of the night and wont be able to sleep because of the pain and spasms. I can have up to 2 or 3 accidents per week but I also have to get up most nights to self cath durig the night because I cant go all night without having a pee. I have a few near falls going to the bathroom to do the isc during the night. The tiolet isnt that far from my bedroom maybe 10 or 12 steps to get to the toilet. I do have grap rails near the door and in the bathroom. There is one in the bedroom but that isnt in the right place at the moment for some reason there just to be one near the door but it got removed before I moved here. I have been at my current home for 6 years now; the longest place I have been in since I was born 39 years ago.

Hi Dee,

I take it that bearing in mind the timescale, you are out of time (over 1 month) to appeal the original decision?.

If so, please bear in mind that asking the DWP to review your claim does carry some risk to your current award. It is impossible on a forum such as this to give specific advice as to your chances of gaining your High rate care award back again.

You really do need to obtain face to face advice to go through your claim in depth, to both assess any risk to your current award and the likelyhood of any increase award.

This link:

www.benefitsandwork.co.uk/faq/general#help

gives details of where individual advice maybe obtained.

Hi Dee,

We cannot give advice on individual claims see FAQ

There is nothing to beat 'face to face' advice, and as you've used a welfare rights adviser in the past, the best advice I can offer is to contact them.

If that's not possible, then see Community Legal Advice

Good luck.

Jim
