I have appealed their decision anyway as I would not have given up my first job in two years unless it was causing me huge problems health-wise.As i have had to have outpatient treatment for increase in pain, increase meds and been referred to Rheumatologist am hoping they realise my existing condition has deteriorated!I will let you know any outcome ,

Hi there
just thought I would update you on this six month rule problem. Sent in a letter of complaint to DWP re non payment of ESA because I truly believe their interpretation is wrong. Had no response so phoned them yesterday and asked why no response given the letter was sent by recorded delivery. They blamed their central post sorting system! No apology! They said they were referring it to be looked at again but said it was my fault because I had nt made it clear in my original claim that my condition had worsened!!!Unfortunately as DWP informed the Tax Office that I was receiving ESA I have now had an incorrect Tax Code allocated so am paying a ridiculous amount of Tax on My Pension. Its a good thing I am a bit of a battler otherwise I would have given up a while ago.Will let you know the outcome. Good luck to anyone out there who is experiencing the same thing. Hi there I spoke to DWP yesterday and they have overturned their dis-allowance of my claim(six month rule query) and have accepted that my condition has worsened.Already had a part payment and the arrears are due in next week .I will have to have another medical assessment and will still have to attend my Tribunal that is outstanding form original clim but feel I have won a small victory. Lots of good wishes to you all
