Hi All

This query is with relation to a worsening condition or a different condition experienced whilst on the ESA assessment phase. A medical has taken place, ATOS confirms the report is available to DWP (cannot provide info on scoring, but has been requested) but a decision has not been returned. What could be the consequences if these changes are reported? Could the DWP be in a position to cease/hold up LCW determination, force a new ESA50, and prolong the assessment phase?

Any thoughts or experiences on this would be gratefully received.

It may be in your interests to await the outcome decision on your ESA claim.

If the decision is favourable and you are placed in either the WRAG or the support group, your new medical condition could be immaterial? However, if your worsening/different condition means you may qualify for the support group, you should let the DWP know of the change of circumstances immediately.

There is a likelihood that the WCA may need to be repeated, especially if you are found fit for work on the basis of you original medical condition.

Unfortunately your case is somewhat unpredictable at the moment, and as such, it is almost impossible to second guess what the DWP would intend to do in your particular situation?
