Just read this topic and was interested to note about the interview and breach of law. When my OH claimed ESA (still in work) it stated on his acceptance letter that I may be asked to attend one of these, even though I am on long term Incapacity! If I get the letter to go, I will quote as you state and see what happens.

I received two letters today, one from Dwp informing me
of exemption from PCA (received January and returned
within two weeks) and one from jobcentre asking me to
attend WFI next week. I attended a Atos medical in
Nov 2008 and the doctor said he was going to exempt
me, was only in there 15 mins. When I phoned the jobcentre
today I said I was exempt and said both lettters
were dated the 12th May. The lady said I received it as
they are computer generated every 3 years and my exemption
hasn't been put on computer yet and she was going
to phone the Dwp officeand then phone me back
I' m still waiting, will phone jobcentre on morning
and if necessary get on my mobility scooter with
a copy of my exemption letter. Such inefficency
pees me right off!.

Hi, Thanks for the reply.
I sent a letter to RBLI telling them I thought I should be exempt.
I got a phone message today saying that she thought I should attend ....DLA makes no difference and she thinks I'm on ESA.
I have replied stating I'm in receipt of IB long term (more than 10 points mental health), DLA highest Care and IS.
I enclosed a copy of my DLA care award which states it was awarded for 'danger of substantial harm to myself or others'.
I copied the factsheet link too.
I really do hope this will satisfy!

Help.... I got a letter from RBLI (Local Delivery Manager) today stating that "You have been refered to the Pathways to Work Program by the job centre plus, who are aware of the benefits you are claiming. Pathways to work is a mandatory program for unemployed people claiming a health related benefit."
No mention of any legistation or the links you suggested I added to the letter.
Who do you think I should contact next?
