As you know I have been complaining of the lenght of time a decision is made. I asked for my son's DLA to be reviwed when we found out last year he had RND [reflex neromuseskeltal dystyophy]in September 09 I sumbmitted the forms,his rates came back the same, I asked for a review and in Feb it came back the same. This left me furious as RND pain is continious not every hour etc or often, i asked for a tribunal hearing and submitted the papers to find that before the papers go to tribunal they are once again in the 12 week rack at DLA to decided if they can change the decision. feeling very frustratd I rang the DLA constantly and sent a letter of complaint, the papers are not listed by the first application but by the last review date. To cut a long story short, my son yesterday was awarded HCR and HRM six months of frustration and papers and we are finally there. But I have to say, the case law I found on this forum is what helped
I thnk if you know you are right don't back down, it is so very important to get the rates you are entitled to and the help you need.
