I sent back my ESA50 in December 2023, the information provided n my opinion and based on the relevant descriptors should have meant that I hopefully would go from (LCW) group and be placed into the Support Group. I didnt here back from ESA, so in March 2024 I applied for PIP, and eventually at assessment awarded Enhanced rates in both Dailly living, and Mobility from June 2024 to June 2027. I still heard nothing in relation to the summitted ESA50, but being in receipt of PIP I just carried on with my life.

In February 2025 I got my migration notice to UC to be submitted by May 2025. 15 months had passed, and I still had not heard from ESA regarding the submitted ESA50 form. So I contacted ESA to ask them what group I was in, just in case it had been changed, and they had not told me. I was told that I was in the (WRAG) group ? I questioned this as given I was in (LCW) when I submitted the ESA50 form, the woman simply replied that she did not know.

I said I would like to speak to a manager in relation to my December 2023 ESA50 form remaining unprocessed, she replied that someone would be in touch. Within an hour I had a call from a person who said they were a Manager, When I informed him my ESA50 was not processed for over 15 months, he casually replied "oh we've got some which have gone on for longer than that."
That kind of set the tone for the rest of his call, where he refused to backdate my claim to December 2023, refused to put my UC migration on hold until the ESA issue was resolved. And said to help me he would put a Deterioration Decision, on my file to protect me, but this meant that I could not backdate my ESA claim to December 2023, and therefore no back payment would be payable.

I asked for a copy of the Deterioration Decision , which he refused, he said I would be sent an assessment appointment in relation to my ESA50 submitted form, but could not say when. And he then said I should continue with mu UC migration deadline in May 2025.
This of course has meant now, trying to gather information for UC migration, along with now having to go through my 15 month old ESA50 form and try to remember and process that as well. I decided to contact my MP, and told him what had happened. Although to date I have not heard back from him. Today I received a letter from ESA not for the anticipated assessment appointment, but to tell me that they were in the process of sending out Capability for work questionnaire.

I'm not sure I can cope now, my anxiety and stress levels are already through the roof, and having to concentrate on A 15 month old ESA50, along with UC migration, and what I thought would be or still might be an ESA Assessment, and now I have to fill in yet another Capability for work questionnaire as well.
It is fair to say that if they are trying to break me, its getting very close, even with the help of B&W Guides, I'm not sure I can do it.

Any information you may be able to give might just make the difference I need to carry on.

I'm sorry - I replied to your other post, but now it seems you have been left with very little choice but to complete the paperwork you have been sent.

I wish I could give you some information or advice, but I don't have any. All I can say is do one at a time and deal with the most urgent, which I assume is the migration notice. If you do that one first, it will give you time to hear back from your MP.

If it feels like it's breaking you, then ring up the DWP and inform them that you are a very vulnerable person and see what support they can offer you to get through this. Don't let them break you.

Hi Bis,
Thank you for your reply,
I just dont understand how I can be sent for an assessment based on a my original ESA50. when they haven't processed it? Then send out another ESA50 when the first one is still outstanding.

Furthermore the Deterioration Decision seems to be not to be well known about. And they would not provide me with a copy?

I was just concerned about the UC migration, by not being placed in the correct group, and I dont know if it will cause me further problems later.

Hi Navigator

There are times where the DWP will refuse to give claimants copies of certain documents because the contents could be harmful to their mental health. Clearly I don't know whether this applies to you - I just flag it as a possible reason. The Deterioration Decision is where a claimants condition has deteriorated since they were last assessed and they should be placed in a group requiring a higher level of support.
