UC Migration and yearly benefit uprating + DLA

Hello

Thank you to this site. You have already answered several of my questions.

I have the Universal Credit Migration Notice which says I must apply by 9th April as my income-related ESA and Housing Benefit will stop. However, I also got another letter from them that the ESA is getting the yearly uprating on 9th April. I believe I will qualify for transitional protection so will I still get the yearly uprating? What if I apply for UC before 9th April? I'm sorry if this is a stupid question but I'm feeling very panicked about my income with the news just now.

My last question is that I am on DLA. I have had an indefinite award of higher rate care and lower rate mobility for about twenty years. I live in Scotland. Why have I not been asked to migrate to PIP or ADP? I used to get letters saying they would get round to asking me then those letters stopped. I don't want to ring them and ask them in case they notice me and then they refuse me (despite my illness being unchanged).

Hi Swana

You qualify for transitional protection, and yes, you will stay eligible for the yearly uprating even if you apply for UC before April 9th.

DLA to PIP migrations were halted until 2028, which is why you haven't heard anything. One of our other members reported the other day that the Scottish government are going to be writing to those on DLA in Scotland and moving them onto ADP. I can't confirm this information, so you need to look at the Scottish government website.

Chances are you will be transferred to the new Scottish DLA rather than ADP

Which DLA awards are moving to Scottish Adult DLA

From 21 March 2025, all adults in Scotland still getting DLA from DWP will move to Scottish Adult DLA.

Before Scottish Adult DLA was introduced on 21 March 2025, some people born on or after 9 April 1948 may have had their award moved to Adult Disability Payment.

This was so changes in their disability or health condition could be reviewed against Adult Disability Payment instead of Personal Independence Payment (PIP) with DWP.

The amount you get will stay the same
You'll keep getting your regular DLA payments from DWP until your benefit moves.

There will be no gap in your entitlement. You’ll be paid the same amount when your benefit moves to Scottish Adult DLA.

When your DLA will move
The move will happen in stages. It will not happen to everyone at the same time.

The process started on 21 March 2025. It will take until the end of 2025 to move everyone’s benefit to Scottish Adult DLA.

Thank you for the information. That is welcome news about Scottish Adult DLA. For anyone else in my position I found this about indefinite awards "The Scottish Government has signalled its intent to provide ongoing awards, subject to light-touch reviews, for Scottish Adult DLA. As such, any individual who has an indefinite award will not have a review date set but where there is a change of circumstances a review of their award will be carried out" from here . Which is the best news I've had in a long time.

Will the new Labour proposals allow me to qualify with Scottish Adult DLA for the health element of UC though? Thanks for all your help.
