Hi ohreally

As you are a carer you should receive the carer's element of UC which is £198.31. But as you say, if you receive Carer's Allowance then it is deducted from the UC.

Dear ohreally [love your username btw!] I'll save the volunteer Mods a little job:
There is always a time disconnect between us posting, and posts appearing. This is due to it being a fully moderated forum. Ie, nothing goes up without being checked for everyone's benefit, so there is always a delay while Mods come online and work their way through the waiting inbox.

Replied by ohreally on topic Universal credit overpayment - please help.
For clarity, I don't receive CA but they may appear to be deducting this with their claimed amount of overpayment.

I'm unsure what next steps should be and I would certainly be looking to hold them to account over this. How can this go unsighted for several years? Why wasn't this flagged up with me when a potential overpayment was suspected> Is it a reasonable reaction to simply bring the payments to a stop.

Can I have a reasonable expectation for them to supply any and all information they hold/ have used in relation to this. Can I see their workings?

Hi ohreally

I would request a copy of all your DWP files which is known as a Subject Access Request ( SAR ).
You can now do this online here-

@ ohreally
I’m not sure if this is helpful to you but independentage has a really good helpline and a comprehensive pdf regarding underlying entitlement www.independentage.org/get-advice/underl...-to-carers-allowance
It's incorrect to deduct an underlying entitlement when it’s not in payment
Best wishes

Hi Kab

I haven't had time to investigate the link but I agree with the sentiments.
