Can I still apply for Employment & support alliance, if migration is going to UC was created by ZenZen
I am a self-employed person who was on working tax-credit., I was migrated over to UC this year. A month ago, had a fall, and now have sciatica nerve pain & bulging disc, seen through MRI. I have received a not fit to work note from my Doctor. Sent to Universal credit. They have sent me a "UC-capability for work questionnaire." Not sent it yet. I know Employment & support alliance hasn't migrated over to Universal Credit yet. Should I apply for ESA, I don't know what to do? any advice.

Hi ZenZen,
You can only claim New Style ESA now which is based on your National Insurance contributions.
However any New Style ESA you were to receive would be deducted from your UC £ for £.
A lot of self employed people have the UC Minimum Income Floor imposed on them which means a reduction in UC . You can avoid the Minimum Income Floor by completing the UC50 and hope you are awarded a health element.
There is lots of good advice regarding completing the UC50/ESA50 here.

Thanks David for the information. I do have all my national insurance contributions. and yes, you're right I have had some UC reductions. Do you think, it's not worth applying for ESA, if they are going to migrate over to UC. ?

Hi ZenZen,
New Style ESA isn't going to be stopped or migrated. The issue is that it will all be deducted from your UC so you won't be any better off.

Another question, With ESA, If you don't work because go health its fine, but if you can work, you can only do 16hrs, and not earn more the around £170 pw. Would this be the same if your on UC?

Hi ZenZen,
I think you are referring to ESA Permitted Work. Unfortunately with UC the Permitted Work scheme is not allowed. It is only possible to apply for Permitted Work on ESA.
