Can someone advise me about benefits and living in a supported tenancy, am I entitled to PIP if I have carers that are part of my 117 aftercare package, just discharged from a mental health hospital under section 37/41 on a COPDOL in the community

I am sorry, but your question is outside the remit of this forum and not something that we cover. You would need to speak to a specialist welfare advisor or the people involved in your aftercare package. There is no automatic entitlement to PIP because someone needs carers. Hopefully, you have someone who can help you apply - but there is no fast-track process for being mentally unwell. Sorry, we can't help further.

BIS is quite correct that it would be better to talk to someone responsible for your aftercare package or a specialist welfare rights adviser - or perhaps both. I do know a little about section 117. Regarding the carers you've told us are provided for you under this I would expect this to be at no cost to you.? If this is so and you claim PIP (or were already receiving it) you may find that you have to pay some of the PIP towards your care costs which were completely free to you before! This is because', especially with respect to the daily living component of PIP, you would effectively then be receiving money TwIICE for your care needs.! I know you wouldn''t receive the money in your pocket under section 117 but it is being paid for you by one part of the system as it were. If you also received PIP albeit from another part of the system ie DWP this is likely to be considered as a "double payment" for your care needs! So just to reiterate it would be a very good idea to speak to your section 117 contact, probably a social worker, and possibly also to a specialist welfare rights adviser. In any case if you were awarded PIP I think you would have to declare this to your section 117 provider anyway.
