Thanks for the info on DLA to PIP, I thought if I got to 65 before I was "invited" then i would stay on DLA, apparently not. I should have been 65 on 8th April this year for that. Never mind, I am confident that using your guides i will still qualify for the enhanced rate even if the walking stays at 20m.
Incidentally, on the ESA support group I have been awarded £71.70 plus £34.80. As I am married, shouldn't that be £112.55 plus £34.80. And how will that affect my award of Pension Guarantee Credit?
Regards
Pete

Hi BP,
Yes, the £71.70 is the ESA personal allowance for an over 25.
The £34.80 is the SG Component.
This is what you would receive for an individual claim/award, in your own right.
Benefit Rates 2012
To receive money for your partner/spouse, you would have to make a joint claim to include them.
As it seems from the title of your topic that you were transferred over from IB, under Transitional Protection you should receive no less, although you can receive more, than you were being paid before being transferred. :
What will I be paid?
Below is a list of premiums that you may be entitled to whilst in The SG :
ESA Premiums
However, to be paid all or part of any of the premiums, as well as fulfilling the qualifying criteria, which for example with the Enhanced Disability Premium, (EDP) is simply being placed into the SG. You would have to be financially assessed for, and be entitled to IR ESA top-ups.
This would involve filling in an ESA3 financial assessment form, which can be obtained from the DWP.

What will I be transferred to?
As you will see, you can be paid CB ESA alone, IR ESA alone, or a combination of both CB ESA and IR ESA.

Phoned DWP, I need to apply for ESA IR with form ESA3 which they are sending. When sorted, my Pension Guarantee Credit will be adjusted automatically so I don't need to inform them.
I asked and was told I will be reassessed in 2yrs, so I asked for form ESA85A and LT54.. "WHAT do you want them for? LT54 is a living together form and not appropriate for you!" This threw me as for the moment I couldn't remember what it was. He said as I had got a good result why do i need the ESA85A, it's only people who get turned down. I only convinced him to send me the ESA85A because I said I was suprised to be assessed at 2yrs and not 3 as I would never get better and would only get worse. He was very antagonistic.
Should I "shut up while I'm in front" so to speak, or risk antagonizing them by sending an SAR? I would really like to know how the DM arrived at 2yrs, this will be 8mths before I'm 65.

Hi BP,
An LT54 Form is not a "living together form"
It is a form filled out by The DM in all conversions to ESA and reconsiderations, so there will be one.
There is a description of an LT54 on this FAQ :
ESA Forms
I should imagine, that your main concern is :
(a) To have written confirmation of the prognosis and the expected date of your next reassessment.
&
(b) The reasons (Descriptors) that placed you into The SG.
The ESA85A may well contain both of the above.
If not, you could issue a SAR requesting The LT54, and/or pose the particular questions at (a) & (b) above.
You should address any SAR FAO The Data Controller (DPA 1998 SAR) to the Benefits Office dealing with your ESA.

From this page :

Sending Documents to the DWP or ATOS
Once received by The DWP, they have 40 calendar days to comply.

Just to add there would not be an ESA85A if you had been found fit for work, as to be found fit for work, you would have had to attended a face to face first.
If you had attended a face to face, it would not have been an ESA85A it would have been an ESA85. :
