Just returned from my First-Tier Appeal 10th October 2013.
Won the case based on satisfying Regulation 29 (2b) and Regulation 35 (2b).
The Information on this Web site was invaluable in preparing for this case as I was representing myself, and I thank you very much.
Well worth the joining fee absolutely brilliant.
As this is the 3rd time i have had to endure an appeal and been excluded from benefits due to the Incompetence of the DWP Decision Makers and the Inept ATOS Medical Healthcare Professionals, I have decided to pursue a claim against both parties for causing Stress,Hardship and anxiety due to their Incompetence.
I have previously made a claim but gave up as I seemed to hit a wall of THE DECISION MAKER HAS CARRIED OUT HIS DUTIES MAKING HIS DECISION USING AVAILABLE INFORMATION, even through
all information supplied by me my GP and Consultant was ignored and only ATOS information was used.
Has anybody made a successful claim against them with regards to there Incompetence ?
Any advice gratefully received.

That is good news K,
Well done !!!
Thanks for the positive comments regarding B&W.
Making such a claim against DWP/ATOS is not a straight forward issue and you may well need to enlist professional support.
