As the ESA Regs 2011 Ammendments have been in force since March 2011, and as it seems that you do not have any problems with your sight, it is highly likely that they have stated ESA Regs 2008 in error.

It is up to you, whether or not you want to query this with The TS.

The DWP may pick up on it, when they receive copy of the Tribunal Decision Notice ?

To put your mind at rest why don't you give the Tribunal Service a ring.

It is not upto you as a lay person to have an understanding of The ESA Regs, etc, it is upto The TS to get this right.

Hi K,

It is simply not possible for The Tribunal to assess your appeal on The 2008 Regs.

Further, the points that they have awarded, as in your first post, 9 points for 3 (b) and 6 points for 9 (b) 15 points in total, correspond with The Ammended 2011 Regs.

My only suggestion, would be to contact The TS, if it is simply a case of them writing ESA Regs 2008 in error, they should be able to rectify it very quickly and send you an ammended Decision Notice, which you could then forward copy of to The DWP.
