Have today received brown envelope putting me in WRAG, until end November this year (only 3 months - is that usual??) Not really sure if being in WRAG is a good thing or not, seeing as I have been on sick since Dec, and gave up my job in May, due to fibromyalgia, spondylosis, arthritis and flares of IBS. My doc obviously thinks I am unfit for work, or he wouldn't keep writing sick notes. Question is should I appeal to get in to the support group, if I do , do I risk losing it all? Is it worth reapplying for DLA based on the ESA medical report?
When I went for the medical, the 'disability analyst' said I automatically got a copy of her comments,(nothing yet), but who do I ask for a copy of the actual medical report?
Also, when I updated my tax credits renewal (even tho I get nowt!),she told me I couldn't possibly be getting income related ESA as I am married and hubby works full time, (My letter states income related) so she said she would have to refer it back to benefits to be reviewed.Confused as to what that might mean for me if they change it to contribution based.
Any answers to my confusion will be very gratefully received.
Thanks in advance
Bren

Please take a look at the FAQ and ESA appeal guide for information.
Why can’t you answer a question about my specific claim?
Is there any risk to challenging a decision?
How can I get individual help with a specific benefits problem?
I don't know why the ADA told you that you automatically get a copy of the medical report; you need to phone the JCP number on the decision letter and ask for it.
Good luck
Derek

Sorry to ask, but how do you know it is only for three months?

It says on the page where they detail your payments that 'the amounts on this page apply from 4 aug to 30 november'. Not quite sure what happens after that tho'!!

Just been on to jobcentreplus to request copy of ATOS medical report - they said they don't do that as ATOS should automatic send in a few days.
Also asked, now I'm in WRAG, if I need to still send sick notes - she said yes, even though the ESA booklet on page 8 says you dont have to. Only wanted to confirm, now even more confused!!!! Do I need sick notes or not ???!!!
Thanks in advance

It's amazing the difference in quality between one of the front end JP+ staff and another.Hi everyone again!

Sorry Bren, but they don't sent the medical report automatically, you need to request it from your local DWP office, either by phone or in writing.
Once you have official confirmation that you have been placed in the WRAG you are no longer required to send Fit notes as the DWP have classed you a Unfit for Work, you remain in this "state" until either you or they, find you Fit for Work.
Hope this explains it.
