Hi
I have email correspondence from Atos that confirms they use disability analysts NOT DOCTORS per se, they attend a short training course. These disability analysts can be a nurse or a physiotherapist CHECK your medical report and x ref with the relevant professional body I.e GMC etc. Each time you send new evidence to the DWP decision maker they are obliged by law to review your claim this can be as many times as necessary and also if you raise a complaint to the DWP Manager they have to review your claim and each time this is done they have to write to you with their decision. If you are still not happy you can raise a complaint with an independent case examiner ( direct.gov.uk). All this can be done either before going to appeal tribunal or while waiting for your appeal to be heard. The DWP cancelled my appeal when I used this route!!

Can I just check that in your complaint to ATOS you gave specific examples of what you said and how the HCP then misinterpreted it? I expect you did, but it's not clear from what you've written. It's crucial to give specific examples so they can't just fob you off.
Also, did your mum TAKE NOTES at the assessment? I would urge anyone attending a WCA with ATOS to take a supportive friend who can take masses of notes. This strengthens your confidence and credibility when you need to dispute inaccuracies.

I have spoken with CAB and the first thing I was asked was 'was the assessment done by a Polish woman?' It seems they have received many complaints about the same doctor including people who have been unable to work all their life due to severe disabilities now being deemed 'fit to work'!!! They said they were looking to make an official complaint against this doctor but why is this being allowed to happen????

In answer to your questions Andy -
Yes I gave specific examples like I said 'son and daughter' my report says 'two daughters'!!! Not medically relevant but if she can get such a small detail wrong. I followed the medical report stating where the inaccuracies where and why...my corrections ran to 11 pages (although alot was repeated as per the medical report). Apart from the poor spelling, bad grammar and things that just don't make sense (anyone know what toileting temperature problems are? I'm guessing it's a combination of my inability to control my temperature and my need to use the toilet alot) the report also states things that happened that didn't and things that did happen don't even feature.
No my mum didn't take notes but i'm just glad she came with me.

From this, and from the level of incompetence you describe in your assessment report, I'm wondering if it might be good to get a journalist involved? Just a thought. Because this sounds like a case of ATOS continuing to use someone who's been shown to be unfit for the job over and over again.
I know it's an uphill struggle, but can I encourage you to KEEP AT IT. Maybe have another go at your MP, mentioning what you found out at the CAB.

i know how u feel,all this has made me ill,been to mental healh today told them im getting panic attacks etc was discharged from mh in jan 2011 was on top of the world, but this medical etc has made me down,pls complain to atos email or write i emailed 3 long letters complaining about this doctor & the so called medical,y,i got letter in post back from atos 2 days later so could you if complain, worry about yourself how u feel and appeal to dwp i sent mine off today recorded delivery with 5 pages,scans,letters from hospital,& not fit work cert from gp.cheers D.
