Hi,
question 58 of the pack included reference to whether or not you have been TURNED DOWN or stopped recieving DLA in the past three years.
I was given dla after my second heart attack in 2009 for twelve months whilst I recovered and then it was removed, so I appealed. (I had another heart attack last year whilst waiting for the appeal) but lost the appeal. I intend to fill out another claim pack due to disabilities due to heart attack number three.
Is this question still relevant, or am I reading from an old claim pack? And would the D.W.P just take the tribunals side and dismiss my claim because the 3rd attack was included in their documentation?

Question 58 on the current claim form is now "About other benefits you are getting or waiting to hear about", so you are probably reading from an old claim pack.

The DWP cannot simply adopt the findings of the appeal tribunal, if your 3rd heart attack has resulted in increased care/mobility needs since the date of the last adverse decision on your DLA entitlement, which was the subject of the appeal. If you do have increased care/mobility needs and you wish to make a reclaim, the current claim form can be downloaded from HERE.
