i am signed of work long term sick at the moment. my employer is bearing with me until at least march 2012.had an occupational health assesment confirming will be unfit for possible 6/9months.sick pay now expired so now on assesment esa.dwp have that assesment report together with proof of forthcoming hospital appointment.atos healthcare medical assesment coming up next week which i an certain they will fail me on possible score 0. will then esa get stopped?? cannot sign on as still employed. any idea what would happen next.

Steve,

If you get less than the 15 points required,or 0 as you think, appeal straight away to be put in the WRAG group.

You will have to provide fit notes from your G.P. whilst awaiting appeal.

While awaiting the Tribunal hearing, you will receive the assessment rate of ESA.

Further you will not have to pay this back if your appeal fails, and by the time the Tribunal hearing takes place, because it is now taking such a long time, you may be back at work.

Also whilst on appeal, they cannot compel you to attend WFI's, as you have a current live contract of employment with your existing job.

If you fail the medical you can appeal the decision on form GL24 obtained from the Jobcentre.
ESA will continue to be paid at the basic rate until the appeal is heard.
Appeal within one month of the decision and continue to send in sick notes.

Should you fail the ESA medical, and you believe you meet the requirements to score 15 or more points then you can appeal the decision.

A pamphlet on how to do this will be included with any ESA Decision letter and we have a guide in the Members area that covers ESA appeals.
