My Friend had a phone call from atos, we know this because the number is on"who calls me"
He answered the phone and asked who is calling please.
The peron at the other end said i need to ask you some personal questions,
My Friend said again who is calling, the other person said cannot tell you under data protection laws.
My wife is a nurse...This is not true
When they phoned myself my wife answred the phone same thing happened, my wife said what paragraph under the data protection law is that then?
The person put the phone down.
They are still ringing twice a day including saterdays
My ib50 form is due in, next week so they should stop soon.

So it is ATOS who call you not the DWP? Who sends the ESA50 out? I always thought that was DWP.

Atos (Medical Services) send out the ESA50s and phone you to arrange the appointment.
I have no problem with Medical Services arranging the appointment as the medical is with them, but the law allows the Secretary of State (DWP) to decide when a claimant should be reassessed. I wonder if it is the DWP or Atos making the decision, or if the DWP have delegated the task to Atos?

It's basically Atos as they are the medical advisers.
Please read page 7 and onwards of the (new) Understanding ESA guide.

I received a call from DWP last week informing me of the changes from IB to ESA. They read a scripted message and informed me that I would be receiving a form ESA50 which I was to complete and return. I was told I may be required to attend a medical and I would be informed of this via telephone. The outcome of the medical ie decision would be made and I would be informed again by telephone. I said this was not acceptable and I wished to be informed via post. I was asked if there was any particular reason why I wanted to be notified by post as opposed to telephone. I explained that I could not always grasp, understand and digest information given by phone and preferred to see it in writing. I was informed that the policy was to be informed by telephone. End of conversation. Oh happy days!
