:angry: Went to my partner's appeal tribunal today and after spending the equivalent of 2 days doing all my research and paperwork as advised on here and by the CAB only to be told i had it all wrong and that i couldn't represent her other than by asking her questions at the end?

I MUST make it clear that you all on here only gave top advice and your guides helped me so much so thanks for that you've all been invaluable! :kiss:

But the info from my CAB adviser was all wrong!
He told me that i would be doing all the talking and that i didn't even have to take my partner. The judge was very patient when i explained my predicament and gave me time to prepare and think of questions. But i couldn't stop the anger, dissapointment and additional stress this caused.

If you are pushed into being someobody's representative (as the CAB are no longer allowed to) make sure you know EXACTLY what that entails and check again before you leave.

If i can be of help to anyone on here then by all means message me and i'll do what i can.

I think it is more a case of there no longer being funds for them to do so.

Although not all CAB offices have offered this service, those that did, had there legal aid funding cut last year.

last year our CAB advisor told me he would come to a tribuneral appeal but would be unable to talk, my partner had to do all the talking, we decided to not bother then found this site, reapplied, was turned down but appealed using the template letter, they arranged a doctors visit and then was awarded what we wanted (condensed from 7 months to a few words) sounds like you adviser got it all wrong but have to agree about this site / forum, first class

Hi Sandy, can i ask you to explain 'your partner had to do all the talking' please.
Were you just told this or did it actually happen. If it did happen were any questions directed to the claimant at all or was you partner the claimant? hope im not confusing you x

Hi, Sian

What an ordeal! But I'm confused. What benefit was this appeal tribunal about? I am awaiting an ESA appeal and have been told I can nominate a representative to accompany me. I was assuming they would be able to speak on my behalf (to put my case, but not to answer questions addressed to me).

Having to do all the talking would be MUCH more stressful. Help!!!
