Thanks Pete,Gorden and original Dave for your replies. So sorry I am so late in replying, I have been in Hospital for a biopsy, results tomorrow!and not been to good this past week.
I am sure I read somewhere years back, on information that the social posted to me that by claiming SDA you got your stamp paid. Is that correct? If so my claim I would be contributory ESA? Thanks Amber

Hi,

Yes if you claim SDA/IB/IS on grounds of disability/ESA your National Insurance 'account' recevies credits for the duration of the claim.

As Gordon posted earlier, if you are in receipt of Contributory SDA then you will be migrated across to Contributory ESA. If you are placed in the WRAG, then as it currently stands, your Contributory ESA will cease after one year. If you are placed into the Support Group your claim, and thus NI credits will continue as long as you remain in the Support Group.

If placed in the WRAG once the one year contributory phase expires, if you can claim Income Related ESA your National Insurance credits will continue.

An interesting written answer from Maria Miller in response to a question from Dame Anne Begg in yesterdays Hansard regarding the expected numbers affected by the one year limit on Contributory ESA for those in the WRAG. It confirms the government are still committed to working on the assumption it will remain as one year.

Dame Anne Begg: To ask the Secretary of State for Work and Pensions what estimate his Department has made of the proportion of claimants who will cease to receive contributory employment and support allowance (ESA) payments having received them for a year, but will not qualify for income-based ESA or any other income replacement benefits in April 2012. [37486]

Maria Miller: As part of the Welfare Reform Bill, we have set out our intention to introduce a time limit of one year for those claiming contributory employment and support allowance (ESA) and who are placed in the Work Related Activity Group (WRAG) from April 2012.

Current estimates suggest that of those affected by the proposal to time limit contributory ESA, it is expected that around 60% will be fully or partially compensated by income-related ESA. A further 20% are expected to be eligible for pension credit, housing benefit, council tax benefit or tax credits. The remaining 20% will not be eligible for income replacement benefits. However, people in this situation will generally either have a working partner or capital over £16,000 so will not be left without resources.

The estimates are subject to change as more information on customers in the Work Related Activity Group becomes available.

Hi Pete,

That's the same Ann Begge, the Scottish MP, a disabled wheelchair user who when interviewed about DLA said she'd gladly give up her DLA to help the less fortunate.

Wouldn't we all if we were on an MP's salary of around £120,000 inclusive of perks.

Hope you're keeping better.

Pat

Thanks Pete,
Just wondering how many years would I have had to claimed SDA, before I would qualify for having paid enough contributions to claim contributory ESA?
Prior to claiming SDA, I had only been well enough to work part time.Is there any way I can find out my contributions or does it just go by a certain number of years that you have claimed SDA?
I need to know, because if it's income related, I will not be able to claim due to my husbands earnings and what my Daughter gives me each week towards her food ect, so my only hope is contributory ESA.Thanks again

If you are currently in receipt of SDA then your transfer to ESA will be considered a continuation of this claim, so you don't need to worry about your NI history and you will be moved to Contribution Based ESA.

Hope this explains it.
