Hi All, After April 2012 I would have been on ESA (Con) over the 1 year that we can claim. Both Doctor and Consultant are saying Iam not Fit for work. Come Aril 2012 do I just summit sick note and go on the assesment phase againg? Any help would be gratefull Thanks Kev

Assuming that you were in the ESA WRAG and not the Support Group, where the one year limitation does not apply, then you would be eligible to claim Incmome Related ESA, subject to you meeting the associated means test.

If you do not qualify for ESA(IR), then I am afraid your ESA payments would stop, until such time as you were able to re-qualify for ESA.

Hi Gordon, Lets assume that I will get a sicknote for April 2012 and onwards do I summit the sicknot to the Benefits Agency? then go on the assesment phase again. In answer to yor question I am on ESA (C), I would not be elegible for ESA (IR) Thanks Kev

In order to re-claim ESA(CB) you would need to have paid sufficient qualifying NI credits in the preceding years, as you would have been on ESA(CB), you would not have been able to do this.

I am afraid that at the end of the year in the WRAG, you will no longer be entitled to claim ESA(CB) and if you do not qualify for ESA(IR), you will bot be able to claim ESA at all, until such time as you have sufficient NI credits for ESA(CB) or you satisfy the means test for ESA(IR).

Back again Gordon, It looks like my best option is to get in the support Group. Do I just notify the Benefits Agency I have a change of circumstances (for the worst). And hope for the best at the Medical I have both my Doctors and Consultants support. that I will not be returning to work with my Medical Condition. Thanks Kev

Hi Kev, to get in the support group you need to fill one of the special criteria, it's not about points.
