Yes I think you do, its worded something like "no one will be refused ESA without being offered a medical" they can award without medical but I am 99% sure its your right

You can certainly request a doctor instead of a nurse, but as far as I am aware, the ultimate decision as to who you see, still lies with ATOS.

I think ATOS are supposed to assess this issue with info they have on your ESA50, and ensure you see the correct type of HCP.

Whether they actually do that is a different matter.
