Hi I am currently appealing for my incapacity benefit. My husband has MS and is on high rate for mobility and care for his DLA. If my appeal fails will I be able to apply for an allowance to care for him? If I do will he be reassesed?

In principle you can apply for ESA on the basis of your being incapable of working, or Carers Allowance on the basis of your husband receiving DLA HRC.
In either case, I would advise you to seek face to face advice, to ensure that you apply for the correct benefit for your circumstances.
There would be no reason for your husband's DLA to be re-assessed as a reult of your applying for CA.
