thanks dave.
i have rheumatoid arthritis and had svere flare up in nov last year. before i was being paid full occupational sick pay but now it is going to be reduced to almost half. so i fulfill that gross earning condition aswell.

thanks dave for posting the link. i am getting occupational sick pay for last 5 months so i do qualify under reg9(6) case E. my earnings are also less than what i was getting before by half now. so that is reduction of 50%. thanks once again.

I think you need to get advice from a tax adviser as ... I cant make out from your posts if you had these problems BEFORE you stopped work if you stopped work because of these problems then IMO you cant claim till you go back... and if you had them before you stopped work you might have a claim but it stops after 28 weeks sick till you go back then there is the 3 month drop to one month for putting a claim in :unsure:

you need serious legal advise from a tax expert/welfare expert

If I was you I would not give in .. if its hard to get expert advise then start by asking them for the regulation used to turn you down .... tax man good at using regs and if they tell you the one used its a good place to start your fight

tax regulations make benefit laws look simple :silly:

i am sorry if i could not explain it much before. now i try to explain in detail again.
i am suffering from rheumatoid arthritis for almost 5 years now. in early nov 2010 i had really bad flare up so i had to take leave from my work. i was full time emplyee working 35 hours a week. now i am on occupational sick leave. on contacting tax credit office,first they refused but when i told that i am on occupational sickleave they relented and asked me to senda proof that i am off sick for last five months, and then they will sort this out for me. hope now it will be more clear.

SORRY but i do't understand 'IMO'.i am new in forums and don'tunderstand forum's lingo.also kindly explain what do you mean by drop from 3 months to one month for putting a claim. again thanks in advance for your guidance.
