Great News. I was receiving high rate mobility indefintely. Applied 25 Jan 11 for care. Received change of circumstances form and completed the same. Received today 10.03.11 a decision. High Rate Mobility for an Indefinate Period and High Rate Care for an Indefinate Period. Without the Benfit Guides doubt whether I would have received this welcomming decision. Thank You all at Benefit and Work for your excellent guides.

Question However: my understanding was that a claim could only be backdated 3 months yet the decision I have received says "...could not date it earlier as you did not notify us within the 13 month period".

I did know there was a 13 month period. Does anyone know anything about this. If there is such a period does anyone know of any good acceptable reasons one could provide to the DLA decision makers.

In September 2009 I contacted the DLA helpline who advised I should wait 3 months after my operation in July 2009 and treatment had finished before applying for DLA Care. My operation went badly wrong and I have never recovered. Since November 2009 I have been receiving Physiotherapy treatment twice weekly and it is still ongoing. There are no prospects of a recovery. I could not therefore give DLA a definite date when or why I did not claim before January 2011. Can anyone assist.

Normally if you are claiming DLA and there is a change of circumstances your increased benefit can normally be backdated to the first payday after hte end of hte three months qualifying period, but it can be backdated for up to 13 months if there were special circumstances that meant it was not practical to report the change earlier.
