DLA was created by ronnyp
Couple of things, I have been waiting on my tribunal since Feb 2010, I was first awarded mobility allowance full rate in 1991 and it was for an indefinate period or until 2025 in October 2009 I was sent a form etc from right payments dept and then in Feb 2010 I had a visit fom a doctor who never examined me just asked me to stand and asked a lot of questions includind how far I could walk . I told him I could walk up drive in pain to the car about 26 metres . A few weeks later I got a letter saying my benifit would be reduced to the low rate care componant one of the things it said was that I could walk 400 metreswhich is a joke, so I lost my mobility componant and had to send car back to motorbility. I have severe arthritus in top 7 vertabrae, a trapped nerve and damage in my lower spine which gives me severe pains in legs etc. I also have carpel tunnel syndrome. and Iam being treated for vertigo. My condition has worsened during time I have been waiting on tribunal and now my medication includes morphine tablets as well as orimorph which is liquid morphine, but I have been told that new medication does not count towards tribunal as I have to prove that I was unfit at time doctor visited me. Also how are the points worked out and how do I complain to ATOS

Nothing on this board constitutes legal advice - always consult a professional about specific problems

You have been told correctly, a Tribunal can only consider facts that would have been available at the time that the Decision was made, so your deterioration would not be considered.
There is an ATOS Complaints Procedures Guide in the Other Benefit Info section of the Members area.
Hope this explains things.

DLA awards are not based on a points system, if you have a look at our DLA guides in the members section they will explain how the system works. My condition has worsened during time I have been waiting on tribunal and now my medication includes morphine tablets as well as orimorph which is liquid morphine, but I have been told that new medication does not count towards tribunal as I have to prove that I was unfit at time doctor visited me.
