I'm very disappointed Heather. I thought for a moment that we got our hands on the new ESA50 before it's suppose to be released.

Maybe it will be sent out early by some incompetent JCP staff. ;)

I'll be very interested to see the new one as I still dont quite get the physichal descriptors proposed for mobilising and especially regarding sitting or rather moving from one seated position to another without assistance from another person. I have an idea how I am going to approach this but can't wait to see how theyve actually worded it. Yesterdays newsletetr puts it at 14th March doesnt it?

There have been many complaints from various organizations that the old ESA50 questions were misleading, incomplete or irrelevant to the legal test. It will be interesting to see if the DWP have taken any notice when producing the the form, but I would guess not.

The new form is due out on 14th March. I presume it will be ceremoniously unveiled, followed by a party to celebrate it's launch. But you have treat the ESA and migration timetable with some caution now.

I have also received the ESA50 10/10 version after being on ESA for 1 year. It is definitely pink, and is different to the previous ESA50, in that it has an "it varies" box for most of the questions. As I do have a condition that varies (ME/CFS), I am concerned, as I have no idea how the "it varies" response works within the points system. Can anyone shed any light on this? Many thanks.

There has been much debate with regard to the "It varies" tick box, including the Moderators, this is my take, others may disagree or have other views :)

I also have ME/CFS, so I understand the problem.

The key thing when trying to decsribe how a fluctuating condition affects your ability to complete each of the tests, is to start with, how you are the majority of the time and then go on to talk about how you are when you are worse. So as an example;

"Four days of the week I am unable to walk more than 100 metres, two additional days I am unable to walk more the 50 metres."

A Welfare Rights worker who spoke at a mh meeting I attended recently suggested the following line of reasoning re mental health descriptors.

If you don't know how you are going to feel from day to day e.g. might wake up fine or in the depths of despair, then you should not tick 'it varies' but put the worst you feel.

I kind of see where she was coming from - this unpredictability is part of what would make one unfit for work - but very much doubt ATOS, the DWP or tribunals would take the same view.
