Hi Mike.
You do not need to have a job to be in receipt of ESA (Income Related).

The wording can be deceptive, the fact that you have no income and have not paid enough NI contributions is the reason you would qualify.

That is of course assuming you pass the WCA (Work capability Assessment).

OK, the first thing to say is that you do not need to be working to receive Income Related ESA, so you don't need to worry about that.

If you remember from when you looked at the Guides, the ESA medical (the WCA), is points based, you need to score 15 or more points to eligible for the WRAG, if you don't score enough points then you "fail".

The means test covers your assets, you need to have less than £16,000 and ideally less £6,000. It also looks at any income you you receive, that is not from your benefits. You haven't mentioned it before, but if you have a partner, then their income and assets are also included in the calculation.

The bottom line is that this is still someway off, and whilst it is important to understand what is going to happen so you can be prepared, you should not spend your time worrying about it.

If you fail the medical, you can appeal if you want, but if you don't appeal, or if you appeal but your appeal is turned down, you won't get ESA.

You could apply for JSA and look for work. Depending on your personal circumstances, you might be entitled to other benefits, such as Carers Allowance if you are looking after someone else etc.

It's worth pointing out that when you claim ESA assessment rate pending appeal, you do not get NI credits. These will only be reinstated if the appeal is allowed.

In other words, you have to gamble with your NI credits for the right to appeal.
