About your appeal For ESA

I received a phone call from the DWP benefit office, they asked me if I still want to go ahead with my appeal to go to a tribunal for my ESA, I told them that I would be going to a tribunal and he said that the paper work was nearly done and that the hearing would be in March. Well I have received a letter today 30/12/10 saying we have looked again at the facts and evidence, we used to make our decision and I would like to inform you that the decision has been revised in your favour. I don’t know what to make of this, the letter went on to say that, the decision and the relevant documents have been returned to the benefit paying section today. Has anyone else had similar notifications?

Hi,
It sounds like your case has been reconsidered favourably.
Were you appealing not receiving ESA, or appealing to be put into the Support Group from the WRAG - if so does the letter say what you have now been awarded?.
The question now being, if you have been put into the Work Related Group are you happy with that or do you wish to appeal to be put into the Support Group.
Obviously there is some risk attached if this is the case as the tribunal could remove what you have already been awarded. Hence if you wish to go further obtain some face to face advice from welfare rights/CAB etc.
Pete
