My husband has just learnt that he has been placed in the WRAG. I have several questions about this.

He has just come to the end of his occupational sick pay and is in no position to return to work yet. Should he voluntarlily resign, would this prejudice his rights to ESA?

He is nearly 63 and I assume he will not have to attend any work focused interviews, is this right?

We are being very positive but his condition (outcomes of brain surgery and heart disease) may not improve. I do not want to appeal and ask for the support group as I want to keep things as positive as possible but am aware that CB ESA is about to become time limited. Can he move from one group to another in the future?

Resigning from his job won't affect his entitlement to ESA (it's JSA it's a problem with).

You only have one month to appeal a decision. On the other hand, if his condition were to deteriorate in the future, you could ask for his ESA to be reviewed.

I can't remember what the rules are for WFIs - hopefully one of my fellow mods will know, or I can look it up later.

Thabnk you. One of the conditions of being obliged to attend the WFI is that you are under the age at which a woman would receive her pension. I think there must have been an equal op challenge here. I may have got it wrong though!

If you've reached the qualifying age for pension credit you should not have to attend PWIs (although you can do so voluntarily :laugh: ).

For people born before 6th April 1950, this is 60.

I am tempted! At his medical he was asked to complete a form by admin staff. he has very poor vision and he tried to use a typoscope ( a rectangle with windows cut out to isolate text and make it more accessible).The staff pushed it away saying that there was not time for that! I mentioned this in my interview with MP about the whole ESA shambles. I understand he is writing to IDS to enquire what disability training ATOS staff receive. If we went for WFI I am sure they would give me more ammunition against this dreadful process but, then again, we ahev put up with enough compost so far.
