Do DWP always listen to the atos dr? was created by John
Hello all,
I had a second "medical" thursday last week for ESA I am currently in WRAG but appealing the decision, the dr just really came in pretty much told me straight away that he was going to recommend the support group just from my form and evidence provided, asked a few questions and left. Have to say not just because of what he said but he was a really nice guy. Seemed a proper caring and interested dr.
Do the DWP generally accept the dr recommendation?
I think I have had so much hassle I do not really believe much these days until it happens.
Also the 2 desriptors I fall into is 1a not able to walk 30 mtrs without pain etc and 7a unable to clean own torso without help. Does this make a DLA claim stronger? I have also appealed my DLA decision of being offered nothign in either mobility or care.

According to the Harrington report the DWP "listen" to ATOS doctors 98% of the time.

Have you obtained a copy of the medical report and decision makers report?
The medical report (ESA85) will state the ATOS doctor's recommendation. If he suggested you should be placed in the support group then the decision makers report will be interesting, as I would expect it to give some explanation of why he disagreed with ATOS.
If the doctor has done what he said and recommended you for the support group, you would be in an enviable position on appeal as the medical report is usually the DWP's main evidence against you.

Thanks Derek....but I may not have worded it all right.
My appeal is for an earlier ESA decision when i was placed in wrag and not support group back in march. I have had a new medical after a secind esa50 and the dr said he is reccommending the support group but this is only last week...no decision has yet come to me.
