Hi
and thanks for the info. My medical didnt focus at all on the main reason for me claiming ESA. Pretty much looked at everything but.
I had my medical cancelled a few times and in that time my conditioned got worse. I phoned atos and dwp to inform of this and to ask if I needed to resubmit a new ESA50, both said no. I questioned them about this and just got a kind of non answer saying just to inform the medical examiner of the changes
nowiknow I should of pulled my finger out and got all my medical evidense together but being so unwell it is very hard to do this. Even with the help from this site.
I know I have done better than most people as regards to be still getting ESA after the medical, but I still feel that I havent really be given a fair chance in representing my condition properly. Thanks for listening err reading. WW

The quickest way to obtain your medical report is to phone JCP and request a copy. If it is in storage it could take up to seven days, however I managed to obtain an old medical report from them within 24 hours. I've been led to believe by JCP staff that they prioritize requests from claimants that are appealing.
Although DWP decision makers usually follow the advice given by the ATOS HCP blindly, as technically the DM makes the decision, I think it is preferable not to respond in full detail until you receive the appeal papers from the DWP, which contains the DM's reasons for the decision. You will then be able to check the papers for incorrect or omitted facts challenge the DM's arguments. DM's do not only rely on assumptions made by the HCP in the medical report, but also make assumptions of their own, based on the assumptions of the HCP.

Just to let you guys know that I recieved my medical report and the points report. It took only 2 days so it was pretty prompt.
I would give the advice of phoning and asking for both the medical report and the decision makers report on the day you recieve the decision from your medical exam.

You've had more luck than me. I asked for my ESA85 and decision makers report but only received the ESA85 though the post.
As I wasn't appealing it didn't matter, but as you have reminded me I will have another go at obtaining the elusive DM report.

The first answere I got when I asked them for the DM report was
"I'm not sure we can give that out to you."
I just replied, persuasively (I liked to think, probably more of a whimper).
"I'm entitled to any info that you have that is about me."
Low and behold 2 days later my documents, all present but only somewhat correct. Hey, at least they turned up.
