My DLA appeal is on Friday morning. The weather forecast for friday is for snow. I really hope to get to the appeal but if I cannot, would it be postponed, or would they hear it in my absence, even though it wasn't my fault I could not attend.
many thanks wordy

If you can't get there, they might not get there too and it won't go ahead,... you would get a new date

Hi,

From the Tribunal Service Website Latest News item on the front page of their website:

29 November 2010
Severe Weather Conditions – Tribunal Hearings
We expect hearings in all our tribunals to go ahead, as planned. However, if the weather in your area is bad, you should contact the office that wrote to you to confirm that your hearing is going ahead.

www.tribunals.gov.uk/

It might be worth ringing them.

Hi Wordy

I think it is very unlikely that the tribunal would refuse to adjourn the hearing if you are unable to attend the hearing and request an adjournment. Proceeding with a hearing in your absence in such circumstances may amount to a breach of natural justice and would be appealable to the Upper Tribunal.

Good luck on Friday.

Derek

i have the answer to that. my appeal last month was in the grotty weather. i phoned the local tribunal office the day before to see if it would still be on. they told me to phone them back at 7am as thats when the office opens and they will know if it will be cancled or not.

when i got there, i was first in. only 1 other person was there for his appeal.
