Hi, it is confusing: I have had a second medical, still on appeal for the first one.... however at this one the nurse told me she would recommend that I am awarded ESA but that her decision still has to be passed by the JOBCENTRE ?
I dont understand this one little bit. Also she did not state if I was still on work related ESA. I also attended the 6 interviews last year too. I also feel harassed by all this indecision and have not fallen ill since the age of 51. Luckily I have visited my local CAB who have a benefits adviser who seems quite smart. Any comments [/b]:huh: ?

The ATOS nurse/doctor merely pass an opinion of your capability to work onto a Decision Maker at the DWP, who is then supposed to make a decision based on all the evidence presented.

I say "supposed" because the recently published Harrington report on the WCA, stated that the DM overrode the ATOS reccommendation only about 2% of the time. So if the nurse has recommended you for ESA, that could be good. :)

Hi Robert

Just to confuse things a bit more I have gone through the same process except I got sick with a long term illness just before my sixth interview.

Since then I have not been back to pathways and have been reassessed by ATOS as fit for for work nil points.

I Telephone the DWP enquiring about my claim for ESA where they said my benefit had stopped and I could appeal so that is what I have done interestingly enough I had a flurry of telephone calls from Pathways asking me what the decision was by ATOS and had I received their letter which I had not at that time.

I got the letter a day later on a Friday.

So the end result I had to supply a fit note from my doctor also sent in an appeal claim form that was sent by the citizens advice my doctor also was asked to complete a report for the citizens advice to send with the claim form this she agreed to do.

Hi,
similar to Paul underwent WFI route and suffered a relapse in My condition underwent another ATOS medical(8/10/2010) scored 24 points (ESA award 18mths) however, the medical report was extremely contradictory as such I appealed for support group status for which at the time I met the descriptors on at least two activities.
Example of one contradiction observed I could not walk more than 10m without pain ticked box I could walk 100m.
The problem being a spinal operation scheduled for March 2011 was brought forward to the 23/10/2010 and I am making good progress as such I no longer meet support group descriptors.
I wish to be able to prove the ATOS professional incorrect in His assumptions
in relation to the last medical by using the comments on His own report however,
without jeopardising My current ESA WRAG
award as I still require at least six mths recuperation.
So questions.
a) Is it best to withdraw appeal for support group?

b)Due to appealing for support group status is this delaying the next round of WFI'S.

although individual advice is not usually afforded is it possible for a hypothetical responce to these questions in relation to My last posting.

a) Is it best to withdraw appeal for support group?

b)Due to appealing for support group status is this delaying the next round of WFI'S.
