Hi all

I appealed my ESA group decision a while ago, at the same time I contacted my local MP's office to see if they would be willing to help. It has taken a while for them to get back to me but they have agreed to help and are drafting a letter to support my appeal.

Obviously due to the time it has taken for them to get back to me and say they will assist has meant that the actual appeal submission time has lapsed quite a bit. How do I submit this information and get it added to the documents I have already sent in at this stage?

Any help/advice greatly appreciated.

when you get letter copy it to DWP and TS also take copies along to tribunal in case they have not got the letter, I would send it special delivery to every one
when you get to talk at the tribunal if its not been added you can read it out when its your turn to talk. that said I am sure if the letter is on headed note paper from the house of commons it should get added in time. all that said I am not sure how there input will help in esa case I can see how people use mp to give dla a kick up the back side ...how will they help with ESA ?

Hi Pusscat

As long as you dont have pages of additional information to take with you, you could take that information with you to the tribunal. I would send copies aswell to DWP decision maker and to the tribunal services. You dont say how close your appeal will be heard. You have nothing to lose by doing all of the above. I had a date for my tribunal and submitted additional information and the original decision was overturned and the tribunal cancelled. So i am proof it is worth sending everything in as my tribunal was cancelled the week before it was due to be heard. I am now in the support group!!!! Yet i only scored 9 points at my atos medical!!!!!!

You will normally get two weeks notice of your tribunal being held, unless you ticked the box for less notice.

You can continue to submit evidence up to this date. Actually this is not a finite limitation, but the Tribunal Service need to copy your evidence an circulate it to all three parties, so I would not go beyond it.

Hi

Thanks for the advice and replies, it's always helpful. I personally do not think there is any harm submitting any further information in support, and I have to say my local MP has been very willing to help, the thing is they are sending the letter directly and I am getting a copy for my records. Now it's likely to be drafted by the end of the week, should I ask them to include a small covering letter explaining that it is additional to my current appeal documents, and why there has been a delay in it being done?

I do not have any date for my appeal yet as I only submitted it in October so I don't anticipate having one any time soon due to the backlog that they have.

If they intend to submit it direct they will need to include your appeal number, and your name and NI number at the top of every page.
