Having followed all the excellent advice from the documents downloaded from here I reaplied for DLA after previously being refused and not having enough courage to face the appeals panel. I ensured I did not skimp on any answers, indeed I went on at length aboutmy average days but was again refused on numerious grounds, my belief was they did not even read my claim properly. I appealed using the standard template from this site and they sent a Doctor to see me. I have just recieved a letter saying they have now reconsidered ny case and asking for more information regarding my hospital / care home status from when I applied and if I had been out of the country for more than 6 months. Am I right in thinking they are going to make some sort of award?
Hi,
Well it sounds more 'positive' than 'negative'.
DLA is not payable after 28 days in hospital or if you go abroad for a lengthy period. If they are enquiring about these things then I would keep my fingers crossed it is going to be a 'positive' result of some sort.
Let us know when you hear.
Pete

Congratulations on your award. You should definitely phone JCP and ask for a copy of the medical report, to keep for your records. It may be useful for a future renewal/appeal and it's far from unknown for the DWP to lose such information.
Best wishes

Have now read the letter from DLA, says the award is made for an indefinite period, now I know what this means in lay terms but does it mean the same in the DWP terms?, may seem a silly ask but stranger things have happened.
thanks for all the help.

It means you have DLA till they decide to look at it again, unless you ask for a review... before the changes that are coiming in that would mean a long time unless you where picked at random for a review.
I would say they will look at your again when the replacment for dla comes in 2013/4 ish
